<br />. <br />. h. <br />1. <br />j. <br /> k. <br /> I. <br /> <br />No underground storage facilities are authorized. <br />No living quarters of any kind, temporary or permanent, are authorized. <br />Holder shall comply with all federal, state and local laws; zoning regulations and <br />standards relating to air, water, land and noise pollution. <br />Holder shall not spill or allow the storage of any toxic or hazardous material on the <br />subject lands during the term of this Permit. <br />Holder shall be responsible for the clean-up or restoration of the Permit area due to <br />contamination by toxic or hazardous material during the term of this Permit. <br /> <br />6. Holder shall not sublet, transfer or assign, in whole or in part, this Permit unless the <br />Water Conservation Board, at its sole discretion, gives written authorization. <br /> <br />a. The Water Conservation Board may charge a fee as a condition for any such <br />authorization. <br />b. Any agreement to sublet, transfer or assign any of the rights granted herein, without <br />said written consent, shall be absolutely void and, at the option of the Water <br />Conservation Board, shall be cause for termination of this Permit. <br />c. Any unapproved agreement to sublet, transfer or assign this Permit shall in no way <br />release the Holder from liability to the Water Conservation Board. It shall be <br />understood by the Holder that any name change shall be deemed an assigmnent and <br />approval of such name change must be obtained from the Water Conservation Board, <br />but such approval may not be unreasonably withheld. <br /> <br />. 7. The Water Conservation Board reserves the right to terminate this Permit by <br />providing ninety (90) days written notice prior to the expiration date in the event of sale, <br />exchange, condemnation or any other disposition of the subject lands. In such event the <br />Holder shall be entitled to compensation for permanent improvements placed on the subject <br />lands, to the extent that said improvements contribute value to the authorized purpose herein, <br />and provided that the Water Conservation Board has authorized the improvements as per <br />Paragraph E.3 herein. <br /> <br />8. Holder has the right to terminate this Permit for any reason, by providing (90) days <br />written notice prior to the desired cancellation date. Termination will occur at the requested <br />date, however, any prepaid Rental for the remainder of the Permit year is not refundable. <br />The Water Conservation Board may use funds held for security under Paragraph D to assure <br />payment of Rental due but not received, particularly when written notice of cancellation is <br />not received in a timely manner prior to the annual Rental due date. <br /> <br />9. If this Permit terminates for any reason, Holder shall have no claim nor right to any <br />compensation for any Permit option beyond the stated term of this Permit, or for any <br />expectation that the Permit term will be extended or the Permit renewed. Holder shall not be <br />entitled to receive any compensation for a leasehold interest in the subject lands, and any <br />such claim shall be cause for termination at the next annual anniversary date of the issuance <br />of this Permit. <br /> <br />e <br />
