<br />10. Upon the termination of this Permit for cause, or at the request of Holder, or by
<br />expiration of term, the Holder agrees to remove all structures and installations of any kind, .
<br />fIll and reshape excavations and drill holes, and restore the land to its original condition, or
<br />as near is practicable, unless requested otherwise in writing by the Water Conservation
<br />Board.
<br />
<br />11. This Permit does not grant the use of water from the subject lands, either from
<br />flowing streams or from wells. Holder shall not establish a water use, water permit or water
<br />right unless the Water Conservation Board at its sole discretion, gives written authorization.
<br />If the Holder uses or establishes any water right on the subject lands, for use on or off state
<br />land, such right shall become and remain the property of the Water Conservation Board.
<br />
<br />12. All rights to any and all minerals, ores and metals of any kind and character, and all
<br />coal asphaltum, oil, gas, geothermal resources or other substances in or under said land are
<br />reserved to the State of Colorado. No salable minerals, such as sand, gravel or stone, found
<br />on the subject lands, shall be removed or used by the Holder unless purchased from the
<br />Water Conservation Board.

<br />13. To the extent authorized by law, the Holder shall indemnify, save and hold harmless
<br />the Water Conservation Board, its employees and agents against any and all claims,
<br />damages, liability and court awards including costs, expenses and attorney fees incurred as a
<br />result of any act or omission by the Holder Or its employees, agents, subcontractors or
<br />assignees pursuant to the terms of this Permit.

<br />14. Holder assumes all liability arising from the exercise of this Permit, including but not
<br />limited to the risk of all injuries, including death, resulting therefrom to persons and damage
<br />to property, including loss of use thereof, and all taxes, fees, assessments or charges,
<br />resulting directly or indirectly, wholly or in part, from this Permit and agrees to indemnify,
<br />save harmless and defend the Water Conservation Board from and against any and all
<br />liability arising therefrom.
<br />
<br />15. Holder will pay full compensation to the Water Conservation Board for damages to its
<br />property ,rights, franchises or privileges, including liabilities and damages to its lessees and
<br />other third parties resulting from acts, omissions or use of the lands or rights granted under
<br />this Permit.
<br />
<br />a. Damage to the state's property including native grass, timber or state-owned
<br />improvements shall be paid for to the state.
<br />b. Damage to private property including fences, crops, irtigation structures, wells,
<br />livestock and privately-owned improvements shall be paid for to the owner thereof.
<br />
<br />16. Failure to comply with any term or condition in this Permit shall be grounds for
<br />termination by the Water Conservation Board.
<br />
<br />17. The following shall apply and supersede any conflicting terms or conditions set forth .
