<br />; <br /> <br />a. Holder agrees to allow and not interfere with any of these existing or new uses. <br />b. The Permit area, where practical, shalI be available for the following agreed to uses . <br />of: <br /> <br />3. The Water Conservation Board reserves the right to sell, exchange or otherwise <br />dispose of the subject lands at any time prior to the expiration date provided, however, that <br />such conveyance is made subject to the terms of this Permit. Holder agrees to allow and not <br />to interfere with said conveyance. <br /> <br />4. By signing this agreement, the Water Conservation Board consents to the <br />construction, placement or continued existence of certain improvements on the subject lands <br />provided their presence is related to the stated purpose of this Permit. The following <br />improvements are considered approved as of the beginning date of this <br />Permit: <br /> <br />a. Prior to commencing any future changes, additions, enlargements or relocations, the <br />Holder shall submit said proposal to the Water Conservation Board for consideration. <br />b. The Water Conservation Board shall approve, deny or recommend modifications to <br />said proposal, in writing, within 30 days of receipt of the proposal. Failure to <br />comment on the proposal within 30 days shall constitute acceptance by the Water <br />Conservation Board. <br />c. Approval shall not be unreasonably withheld, provided that the proposed changes are <br />directly related to the stated purpose of this Permit. However, as a condition of . <br />approval, the Water,Conservation Board may require additional security, as per <br />Paragraph D. <br />d. If the Water Conservation Board denies the request, the proposal shall not be <br />performed under the terms of this Permit. <br /> <br />5. All operations of the Holder shall be conducted in a reasonable and workmanlike <br />manner, and all precautions shall be taken to avoid any damage to the state land or the <br />property of state lessees, specifically including, but not limited to the following: <br /> <br />a. No more of the land shall be disturbed than is absolutely necessary for the stated <br />purpose of this Permit. <br />b. Where practicable, existing roads or paths shall be used. This Permit does not allow <br />vehicular use off the designated area, except for essential ingress and egress to and <br />from the Permit area. <br />c. Holder shall not fence or otherwise obstruct free and open access to and travel upon <br />subject lands without written authorization from the Water Conservation Board. <br />d. Holder is to provide drainage and erosion control structures, fences, gates, or any <br />other facilities necessary to protect state land. <br />e. Excavations, drill holes, fences, roads and other improvements shall be maintained in <br />a safe condition to prevent injury to persons, livestock and wildlife. <br />f. Timber is not to be cut unless specifically authorized. Any related waste materials, <br />including slash and stumps, are to be disposed of by the Holder. <br />g. No refuse, waste or litter of any kind shall be left on the land. <br /> <br />. <br />
