<br />interested in observing project construction in detail work being done by Ames <br />Construction. Recall that the enlargement is estimated to cost approximately $27 million <br />for development of an additional 17,000 acre feet, 5,000 acre-feet of which will go to the <br />Recovery Program for flow augmentation through critical endangered fish habitat in the <br />Lower Yampa River. <br /> <br />Colorado Foundation For Water Education Yampa/White Tour: The Foundation <br />held its second annual tour, this year focusing on the Yampa and White Rivers. Senator <br />Taylor and Ted Kowalski, of the CWCB Staff spoke on RICDs and the Steamboat <br />Springs RICD. By all accounts, this second annual tour was a success. Next summer, the <br />Foundation is planning on touring the headwaters of the South Platte River, the Arkansas <br />River and the Colorado River. <br /> <br />Steamboat Springs Settles with Upper Yampa River Water Conservancy District, <br />Remands Matter Back to the CWCB: The Judge for Water Division No.6 approved <br />a stipulation between the City and the District, which included lower stream flows. The <br />Judge also ordered that the Board reconsider its findings of fact and recommendations, <br />based on the lower stream flows. The Board will discuss this item at the Board meeting. <br /> <br />Agency Updates <br /> <br />Enforcement Action - On June 29 the Division of Water Resources Division 1 staff <br />contacted CWCB staff to inform them that the CWCB' s Tarryall Creek instream flow <br />water right, decreed in Case No. 1-77W8729, was being injured due to a landowners' <br />alteration of the creek. Apparently, the landowner backfilled the natural stream channel <br />and dug a new 1,000 foot long channel through which the re-routed creek flows and then <br />returns to the natural stream channel. After consulting with CWCB staff, on June 30, <br />2005, the DWR issued an "Order to Cease and Desist Illegal Diversion of Surface Water <br />and Remove Unnecessary Obstruction to Stream Flow." The order gives the landowner <br />15 days to comply, at which time the DWR will file a court action for an injunction if the <br />landowner has not complied with the order. As of the date of this report, CWCB staff <br />had not received an update regarding compliance with the order. Staff will update the <br />Board at the July Board meeting. <br /> <br />ISF Subcommittee Update: During this past year, CWCB staff worked with the Board <br />and key stakeholders to develop a Strategic Plan for the Stream and Lake Protection <br />Section. The strategic planning process included several workshops and interviews with <br />the Board, staff and the public. Through this process, several issues related to Instream <br />Flow Program policies and procedures were identified for further discussion. In March <br />2005, the Board created a separate ISF Subcommittee to specifically address those <br />identified issues.
