<br />- <br /> <br />.' <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />,..... <br /> <br />lne Board's organic statutes (37-60-101, et seq.) do not <br />provide specific guidance as to the standards or criteria for such <br />designations. However, 37-60-106(1)(k) does state that the Board <br />has the power "in general, to take such action and have such <br />powers as are incidental to the foregoing specific provisions and <br />to the general purposes of the article," and 37-60-108 provides <br />that"... the Board may adopt such rules and regulations as are <br />necessary or expedient for the conduct of its business and the <br />administration of this article" (i.e., article 60 of title 37). <br /> <br />Specific authority for the Board to set standards for the <br />delineation of floodplains is found at 24-65.1-403(3), CRS (1982 <br />replacement volume), article 65.1 being the H.B. 1041 land use <br />legislation which was passed in 1974. Seotion 24-65.1-403(3) <br />provides that: <br /> <br />(a) Any local government applying for federal or <br />~tate financial assistance for floodplain studies shall <br />provide prior notification to the Colorado Water <br />Conservation Board. The Board shall coordinate and <br />prescribe the standards for all floodplain studies <br />conducted pursuant to this .rticle, including those <br />conducted by federal, local, or other state agencies, <br />to the end that reasonably uniform standards can be <br />applied to the identification and designation cf all <br />floodplains within the state and to minimize <br />duplication of effort. <br /> <br />(b) No floodplains shall be designated by any <br />local government until such designation has been first <br />approved by the Colorado Water Conservation Board as <br />'provided in section 30-28-111 and 31-23-301 <br /> <br />Other provisions of article 65.1 which are relevant to the <br />Board's floodplain management authorities are: <br /> <br />103(7)--definition of "floodplain" <br /> <br />103(13)--definition of "natural hazard," to include floods <br /> <br />103(14)--definition of "natural hazard area," to include <br />floodplains <br /> <br />202(2)(a)(I) and (b)--administration of natural hazard areas <br /> <br />302(2)--authorizes the Board to provide technical assistance <br />to local governments for the permitting processes of <br />article 65.1. <br /> <br />/bvm <br /> <br />-2- <br /> <br />..' <br />
