FLOODPLAIN DESIGNATION AUTHORITIES
OF THE
COLORADO WATER CQNSERVATION BOARD

Pursuant to 37-60-106(1)(c), CRS, the Colorado Water
Conservation Board (Board) has the power, and it is its duty, to:

... designate and approve storm or floodwater runoff
channels or basins, and to make such designations avail-
able to legislative bodies of cities and incorporated
towns, to county planning commissions, and to boards of
adjustment of cities, incorporated towns, and counties

Such designation and approval by ~he Board is a prerequisite
to the exercise of a town's, city's, or county's zoning powers to
lessen or avoid damages to persons and property. The relevant
statute for counties is found at 30-28-111, CRS (pocket
supplement, 1977 replacement volume):

(1) .... To the end that adequate safety may be
secured, the county planning commission may include in
... zoning plan[s] provisions establishing, regulating,
and limiting such uses on or along any runoff channel or
basin as such storm or floodwater runoff channel has
been designated and approved by the Colorado Water
Conservation Board in order to lessen or avoid the
hazards to persons and damage to property resulting from
the accumulation of storm or floodwaters.

(2) The county planning commission or the board of
adjustment of any county... may condition any portion
of a zoning resolution, any amendment thereto, or any
exception to the terms thereof upon the preservation,
improvement, or construction of any storm or floodwater
runoff channel designated and approved by the Colorado
Water Conservation Board.
