<br />'''}' <br /> <br />, <br />r <br />/ <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />CWCB <br />11/7/84 <br /> <br />FLOODPLAIN DESIGNATION AUTHORITIES <br />OF THE <br />COLORADO WATER CQNSERVATION BOARD <br /> <br />Pursuant to 37-60-106(1)(c), CRS, the Colorado Water <br />Conservation Board (Board) has the power, and it is its duty, to: <br /> <br />... designate and approve storm or floodwater runoff <br />channels or basins, and to make such designations avail- <br />able to legislative bodies of cities and incorporated <br />towns, to county planning commissions, and to boards of <br />adjustment of cities, incorporated towns, and counties <br /> <br />Such designation and approval by ~he Board is a prerequisite <br />to the exercise of a town's, city's, or county's zoning powers to <br />lessen or avoid damages to persons and property. The relevant <br />statute for counties is found at 30-28-111, CRS (pocket <br />supplement, 1977 replacement volume): <br /> <br />(1) .... To the end that adequate safety may be <br />secured, the county planning commission may include in <br />... zoning plan[s] provisions establishing, regulating, <br />and limiting such uses on or along any runoff channel or <br />basin as such storm or floodwater runoff channel has <br />been designated and approved by the Colorado Water <br />Conservation Board in order to lessen or avoid the <br />hazards to persons and damage to property resulting from <br />the accumulation of storm or floodwaters. <br /> <br />(2) The county planning commission or the board of <br />adjustment of any county... may condition any portion <br />of a zoning resolution, any amendment thereto, or any <br />exception to the terms thereof upon the preservation, <br />improvement, or construction of any storm or floodwater <br />runoff channel designated and approved by the Colorado <br />Water Conservation Board. <br /> <br />with respect to cities and incorporated towns, nearly identical <br />provisions are found at 31-23-301 (1) and (3), CRS (pocket <br />supplement, 1977 replacement volume).
