<br />Executive Session <br />Tape 6 Start/Stop <br /> <br />12:50 p.m. <br />3270 - 3309 <br /> <br />e <br /> <br />Ray Wright made the motion to go to Executive Session. The motion <br />was seconded by Tyler Martineau and passed unanimously (6-0). <br />12:50 p.m. <br /> <br />Matters discussed in Executive Session 2:28 - 2:30 <br />Tape 6 Start/Stop 3320 - <br />Action: 1) The Board discussed legal strategy in pursuing the litigation in the <br />A1torfer case. The Board's position is that it has exclusive authority to <br />hold instream flow rights. <br />2) The Board also discussed the Colorado River Issues regarding the <br />Glen Canyon Darn, regarding issues that need to be addressed in <br />litigation that could develop. These issues the forum, legal issues, <br />potential legal issues that could arise, third party interveners, and <br />coordination with other states. <br />3) The third item that the Board discussed was the St. Vrain proposed <br />settlement that was discussed prior to going into executive session and <br />the Board gave staff directions to continue negotiations with the City <br />of Longmont. <br /> <br />19 a. Interim Protection Strategy for Instream Flows e <br />& b. Flow Protection Enforcement Agreement 3:08 - <br />Tape 7/8 Start/Stop 7 / 1 7 8 0 end <br />8/001 - 110 <br />Action: A motion was made by Jim Lochhead that with the understanding that <br />there is further public input on these comments that the Board adopt <br />the staff recommendations - that first the Board direct staff to come up <br />with an agreement to incorporate the interim/modifiable flow concept <br />into an agfeement that will correct all of these issues. The second is <br />that the Board authorize the Director to execute the enforcement <br />agreement with the Fish & Wildlife Service. The motion was seconded <br />by Tommy Thomson and passed unanimously (9-0). <br /> <br />19c. Resolution - Applicability of Enforcement Agreement to 581 cfs Appropriation for <br />Instream Flow Protection in the 15 Mile Reach, Colorado River Mainstem 3:08 - <br />Tape 8 Start/Stop IlO - 120 <br />Action: A motion was made by Jim Lochhead that having approved the <br />agreement that the Board indicate its intent to apply the agreement to <br />the existing 581 cfs appropriation.
