Report on Matters Discussed in Executive Session, as necessary (1:59 - 2:00 p.m.) tit <br /> <br />Jennifer Gimbel, AG staff, reported that during executive session the Board <br />discussed the Highlands Ditch and Reservoir Company case against the Arkansas <br />River Commission and a personnel action in Harvey vs. DNR, CWCB and David <br />Walker where a complaint has been filed and an answer has been filed by the AG's <br />office. . <br /> <br />14a. Colorado River Matters, Seven Basin States Negotiations (2:00 - 2:14 p.m.) <br /> <br />Jim Lochhead, Colorado River Commissioner, reported on a meeting held at Salt <br />Lake City, Utah, among the seven basin: states to discuss the land fallowing program <br />agreement between the USBR and the Palos Verde Irrigation District and the <br />proposed pilot program between California and Arizona to allow ground water <br />storage in Arizona for later use by California. Discussion followed by Harrison, <br />Lochhead, and Gene J encsok. <br /> <br />14b. Colorado River Matters, Position Paper of Indian Tribes (2:14 - 2:19 p.m.) <br /> <br />Jim Lochhead reviewed elements of the position paper and reported on four A <br />concerns raised by the tribes at a meeting held at Albuquerque, New Mexico on ... . <br />September 1, 1992 which was attended by Lochhead and We. <br /> <br />14c. Colorado River Matters, 1993 AOP (2:19 - 2:39 p.m.) <br /> <br />Jim Lochhead discussed the status of the Annual Operating Plan for 1993 including <br />the decree accounting method assumptions and concern with the Recovery Program <br />of the Endangered Species Act to increase the risk of a compact call. Questions <br />were asked by Eisel, Harrison, We, Evans, Gene Jencsok, and Simpson. George <br />Smith, Fish and Wildlife Service and Eric Kuhn of the CRWCD made comments <br />from the audience. A meeting of the Colorado River Advisory Council was set up <br />for October 5, 1992 in Denver. <br /> <br />14e. Colorado River Matters, Indian Tribal Issues (added) (2:39 - 2:49 p.m.) <br /> <br />Jim Lochhead discussed the significance of a reserved rights settlement agreement <br />entered into by the Hickoria-Apache Indian Tribe of New Mexico. There was <br />concern that proposed legislation in Congress would allow the tribe to bring a <br />challenge or other action to initiate the ability to lease water off reservation. <br />Questions were asked by Harrison, Jencsok, LiIe, and Eisel.
