<br />the memorandum submitted by Mr. McDonald be adopted as Board <br />pOlicy and direction, Seconded by Mr, Kroeger, The motion <br />carried on a unanimous voice vote. <br /> <br />Concerning completion of item 7d, Mr, Kroeger moved, with a <br />second by Mr, Getz, that the proposed list of projects on page 3 <br />of memorandum covering item 7c be revised to conform to the <br />Board's previous actions of the proposals, <br /> <br />I <br /> <br />Agenda item 18 concerning the instream flow program was <br />considered next. Mr, Merriman described a stipulation negotiated <br />on Jackson County filings. (See Appendix F.) He noted that 21 <br />cases are affected in which the Board would subordinate its <br />rights to development of irrigation water up to that in the North <br />Platte Compact. Mr, Steve Ray, attorney for the North Park <br />interests, said that the stipulations are the result of signifi- <br />cant negotiations and he recommended ratification, Mr. Furneaux <br />also noted the large amount of work by all parties in reaching <br />agreement, and it is acceptable to all. He therefore moved <br />ratification of the stipulation. Seconded by Mr. Johnston. <br />Motion carried on a unanimous voice vote. Mr. Jackson complimen- <br />ted all those who worked so hard to achieve agreement, <br /> <br />Mr, Merriman then presented new Jackson County filings under <br />agenda item 18b, (See Appendix G,') He recommended the following <br />changes based upon further staff review: <br /> <br />For the South Fork of the Michigan River, the segment is <br />shortened from 12,5 miles to 9 miles. The lower point becomes <br />the confluence with Silver Creek at latitude 400 28' 54" N, <br />longitude 1060 00' 26" W. Further, the land ownership is changed <br />to 0% private, 0% state, 100% federal, and 0% other, The winter <br />flow recommendation is changed to 3 cfs, <br /> <br />Mr. Merriman pointed out that recommendations as presented <br />represent significant changes from those initially proposed by <br />the Division of Wildlife and presented to the Board as <br />preliminary recommendations on July 8, 1980, The changes <br />resulted from staff review and major negotiations among the <br />interested parties. <br /> <br />Mr. Furneaux moved approval as corrected and including the <br />stipulation previously adopted, Seconded by Mr. Johnston, The <br />motion carried by unanimous voice vote. <br /> <br />Mr. Jencsok discussed the Statements of Opposition I <br />recommended by staff, (See Appendix H.) The objections were <br />requested to obtain information necessary to determine whether or <br />not the action might adversely affect the Board's decree. Mr. <br />Johnston expressed concern over that approach because it may <br />unduly burden the applicant.
