0). The Attorney General's Office was directed to prepare and file a brief on
this issue. In the second Executive Session report given on Tuesday
morning, a motion was made by Janice Sheftel that if the 15- Mile Reach case
(Case #92CW330) can't be settled promptly, then the Attorney General's
Office be directed to proceed to trial. The motion was seconded by Patricia
Wells and approved unanimously (10-0).

6a. Floodplain Designations and Approvals

Action:Items 6(a)(i) through 6(a)(vi) were discussed simultaneously. A motion was made
by David Smith that the Board approve and designate detailed and
approximate 100-year floodplains in the floodplain resolutions listed in the
agenda. The motion was seconded by Patricia Wells and approved
unanimously (9-0). A motion was made by David Smith that the Board
approve and designate as the approximate 100-year floodplains the Flood
Hazard Boundary Maps listed in the agenda. The motion was seconded by
Janice Sheftel and approved unanimously (9-0).

6b. South Suburban Park and Recreation District, Request for Bowles Avenue Underpass
Approval

Action:A motion was made by Patricia Wells that the Board approve the staff
recommendation for the easements for the South Suburban Park and
Recreation District for the construction project, and for the discharge of
stormwater drainage across CWCB rights-of-way, and for reconstruction of
the left bank channel section in the vicinity of Bowles A venue. The motion
was seconded by Ray Werner and approved unanimously (8-0). After this
action, there was an informal discussion on the South Platte maintenance and
cleanup. No action was taken.

7ai. Feasibility Study Loans - City of Greeley

Action:A motion was made by Patricia Wells that the Board accept the staff
recommendation to approve a feasibility study loan of up to $22,500 to the
City of Greeley for an update of the Twin Lakes Dam feasibility study, and to
discuss with the City the repayment of the pro-rated study costs of $18,280
for Twin Lakes Dam in the 1986 contract with the City. The motion was
seconded by David Meyring and approved unanimously (9-0).
