478

MR. BAILEY:

"One time Charlie Patterson, who used '
to be Engineer for this Board, told me
that he thought in this the Wyoming claims
were padded quite a lot. He said if the
case'were re-opened, Colorado might do the
same.

I

MR. ROBERTS:

"One other matter which has been suggested--
I do not know if I agree with it--and that
is that lhis case has been before the Court
four different times and that Colorado may
have other cases before the Court, such as
the Arizona-California case, and we might
get to that litigation on the Rio Grande,
and the thought suggested was that if we
went back on this case, the Court might
become impatient with Colorado and not be'
too friendly with what we say in the other
cases. I am not too impressed with that."

"We discussed that in our meeting yesterday.
That possibility is quite out of line with
my thinking about that Court and its be-
havior. I really can't imagine any Court of
the United States forming a prejudice to
any State in the Union for such a reason.
I can't see any hazard of exhausting our
credit with that Court or of antagonizing
that Court with any presentation the
Attorney General might make."

MR. BAILEY:

"The personnel of the Court has changed.
They do not have the same judges as
before."

MR. ROBERTS:

"I feel that of all " the points outlined'
in your letter to us, that is the one
that should least deter us."

MR. BAILEY: "I feel the same way."
MR. ROBERTS: "From a lawyer's point of view, that just I
doesn't happen. "
MR. BAILEY: , . "Do you have any comments?"
