<br />DRAFT <br /> <br />. <br /> <br />viii. Whether a reasonable demand exists for the recreational activity in <br />question as determined through estimates of future use; <br />IX. Any appropriate 1illlitations upon the time of day, days per month, <br />or seasons during which the RlCD would be exercised; and, <br />x. The availability and cost of alternative means of providing that <br />minimum stream flow necessary for a reasonable recreational <br />experience. <br />f. Whether the flow amounts sought represent the minimum stream flow to <br />provide a reasonable recreation experience in and on the water. The Board, in <br />making this recommendation, shall consider the following factors (and any <br />other appropriate factors) and if any of the following factors are not satisfied <br />the Board shall not recommend approval of the RlCD: <br />i. Whether the flow amounts requested are less than the average <br />monthly flows on the affected stream segment; <br />ii. Whether the flow amounts requested are less than the amount of <br />water that the Corbett method, or any other reasonable <br />quantification method, suggests; <br />iii. Whether the amount of water applied for is limited to the amount <br />necessary, during the time of recreational use, to transport the <br />recreational craft without harm or imminent threat of harm to the <br />recreational participants; <br />iv. Whether there are adequate lighting conditions, consisting of <br />daylight or artificial lighting, to ensure a safe recreational <br />experience; and, <br />v. Whether the flow amounts are limited to the amount necessary for <br />boat passage through the stream segment. <br />g. Whether the Applicant is or will be diverting, capturing, and controlling water in <br />its natural course or location with physical control structures. The Board, in <br />making this recommendation, shall consider the following factors (and any other <br />appropriate factors) and if any of the following factors are not satisfied the Board <br />shall not recommend approval of the RlCD: <br />i. Whether the structures span the whole width of the stream; <br />ii. Whether the structures are keyed into the banks; <br />iii. Whether the structures are permanent structures; <br />iv. Whether the diversion can be adequately measured and <br />administered in priority; <br />v. Whether the structures will change the direction of flow of water; <br />and, <br />vi. Whether the physical control structures, within the reach of the <br />stream affected by the RlCD, concentrate or control the flow of the <br />stream to assure a reasonable recreational experience with a <br />minimal amount of flow within the reach of the stream affected by <br />the RlCD. <br />13. Additional Findings. The Board may consider the following factors (and any other <br />appropriate factors) when making its written Findings of Fact and Recommendation <br />to the water court: <br /> <br />. <br /> <br />. <br /> <br />7 <br />
