What the appropriate season of use and tiIl1e of use should be; <br />c. Whether additional gages or measuriqg devices are necessary for proper <br />administration of the RICD; <br />d. Whether the flow amounts requested in the RICD application are available for <br />appropriation, and with what frequency and duration are the flow amounts <br />requested in the RICD available; <br />e. Whether the water quality of the stream is appropriate for the recreational use <br />being sought; <br />f. Whether the RICD will affect the water quality classification negatively such that <br />the RICD is inappropriate; . <br />g. Whether the RICD will have a negative effect on current flood elevations; <br />h. Whether there is potential for future exchanges, changes of water rights, or new <br />Beneficial Uses of water upstream of the RICD; and, <br />i. Other factors as may be appropriately raised by Board members or persons <br />testifying before the Board. <br /> <br />. <br /> <br />14. Lack of Information. If the Board does not have adequate information to make all <br />of the fmdings required under Rule 12 of the RICD Rules, the Board may recommend <br />denial of the application. . <br /> <br />15. Variances. The Board or its Hearing Cooidinator may grant a variance from any <br />procedural requirements of these rules if strict application of these rules would not be <br />in the interest of fairness. <br /> <br />. <br /> <br />16. Submission of Findings and Recommendation to the water court. Pursuant to <br />section 37-92-102(6)(c), the Board shal,l submit its Findings of Fact and <br />reconnnendation to the water court within ,90 days after the final closiog date for <br />filing statements of opposition. However, thb Board may request that the water court <br />grant additional time to the Board for makirtg and reporting its Fiodings of Fact and <br />its reconnnendations. ! <br /> <br />. <br /> <br />8 <br />
