<br />DRAFT <br /> <br />iv. Whether the reach is located on private or public lands; <br />v. Whether the water quality of the stream is appropriate for the <br />recreational use being soug~t; <br />vi. Whether water uses withi\1 the reach may be impacted by the <br />RICD; and, <br />vii. Whether obstructions or impediments to the recreational use exist <br />within the reach. . <br />c. Whether there is a legal right for access for the intended recreational in-channel <br />uses. The Board, in making this recommendation, shall consider the following <br />factors (and any other appropriate factors)! <br />i. The nature and extent of the access required for the activity for <br />which a RlCD is being sought; <br />ii. The ownership, leasehold, IJr other legal interest held by or readily <br />available to the Applicant for purposes of obtaining access; <br />iii. The ability to gain access !without materially interfering with the <br />vested property rights of others; <br />iv. Whether the reach is located on private or public lands; and, <br />v. Any impediments to th* access necessary for a reasonable <br />recreational experience in !jnd on the water. <br />d. Whether the exercise of the RlCD woul~ cause material injury to existing ISF <br />water rights. The Board, in making this recommendation, shall consider the <br />following factors (and any other appropriate factors): <br />i. The nature and extent of the ISF in the subject reach; and, <br />ii. Whether the RlCD would inundate the ISF or materially modify <br />the rate of flow through the RlCD reach or a downstream reach in <br />which an ISF exists. <br />e. Whether the adjudication and administratIon of the RlCD would preclude <br />maximum utilization of the waters of the ~tate. The Board, in making this <br />recommendation, shall consider the folloWing factors (and any other appropriate <br />factors): . <br />i. Whether there are any envisioned future exchanges through the <br />proposed reach of stream; <br />ii. Whether there is any ;potential for future upstream junior <br />appropriations; , <br />iii. Whether there are any futUre upstream sites appropriate for storage <br />reservoirs; ] <br />iv. Whether there are any op*ortunities for future upstream transbasin <br />diversions; i <br />v. Whether there are any envisioned future changes of water rights <br />from points of diversion downstream of the reach affected by the <br />RlCD to points upstream ~fthe reach affected by the RlCD; <br />vi. Whether a reasonable meims is to be utilized to divert, capture and <br />control the water so as to jninimize its call upon the river and avoid <br />waste; i <br />, <br />vii. The effect of the RlCIj> upon other valuable state resources, <br />including established fisheries and riparian environments; <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />6 <br />
