M. by Vice- <br />Chairman Chris Wallrich. <br /> <br />Director Stone made a full report of the status of the Rivers and Harbor' <br />and Flood Control legislation pending before the Congres~ of the United State$, and <br />of the, Mntroversy which had been areated through the efforts to obtain the amendme, <br />of this legislation by the inclueion of the so-called O'Mahoney-Millikin amendments <br />to H. R. 3961 (The OmnibuS' Rivera ana Harbors; Bill) and to H. R. 4485 (The Omnibull;:i <br />Flood Control Bill). Direetol'" Stone reviewed the hearings before the COllllllerce' <br />Committee of the Senata, discussed the provisions; of the proposed emendment~ and <br />explained that united effort on the part o~ the states supporting these amend- <br />ments wae necessary to obtain the type or legislation whiohwould protect the <br />states in their future program of water utilization and conservation. <br /> <br />Mr. George Pughe proposed and moved the adoption of the following <br />resolution: <br /> <br />WHEREAS. there is pending bei'ore the Congress of the United <br />States' H. R. ~961 (being an Omnibus River~ and Harbors project <br />authorization bill) and H. R. 4485 (being an Omnibus Flood <br />Control project authorization bill): <br /> <br />AND, WHEI1EAS. certain amendments" gepsr!,lly J,mown as the <br />O'l1ahoney-l1illikin amendment., to these bill& have been <br />introduoed and extensive hearings thereon held before the <br />COlll.'1leroe CO!l1lllittee> of the United States; Senate: <br /> <br />WF.EREAS,. these amendment a provide for reoognition in law <br />of the following principles. <br /> <br />1. That in project planning end investigation for Rivers and <br />Earbor~ improverr~nt~, Flood Control and the development of <br />water resources for oonservation and benefioial use, the <br />respective states; effected) by such improvements: and projeot <br />development be afforded an opportunity to express their vieW$ <br />and participate in an appro?riate manner during project <br />planning and investigation; and that there be authorized by <br />Federal law appropriate means for desirable oooperation <br />between the states; and the Federal Government in suoh aotivities. . <br /> <br />2. That by Congressional direct~ve there be set up a pro- <br />oedu~ for the' integration of the activities; of the Bureau or <br />Reolame.tion and the Corpu of Army Engineers in project planning, <br />investigation and reporting thereon. <br /> <br />~. That in planning, construction and operation of water use <br />and development, projects;, including flood control, there be <br />assurance of the observance of applicable state laws pertaining <br />to the use and control or water.' and that the Commerce Clause <br />of the Federal Constitution be exercised by th~ Congress in <br />sue!\! e. manner as not to enoroaoh upon and defeat state water <br />laws heretofore reoognize~ by t~e Federal Government. <br />
