Sparks, Director <br /> <br />SUBJECT: Agenda Item NO.2, Pending legislation re Colorado Water <br />Conservation Board Construction Fund (Senate Bill 69) <br /> <br />Enclosed herewith is a copy of Senate Bill 69 introduced <br />into the General Assembly this week by Senator Anderson and others. <br />This bill relates to the Colorado Water Conservation Board Construc- <br />tion Fund. The subject matter of this bill was included in the recom- <br />mended legislative program submitted to theaeneralAssembly by Governor <br />Lamm. However, the specific appropriation, as hereinafter described, <br />is a matter which will have to be determined by the General Assembly. <br /> <br />Section 1 of the bill amends the existing statute relating <br />to the authority of the board to construct water and power projects, <br />and places special emphasis upon water conservation measures. It is <br />less than clear under the present law as to the actual scope of the <br />board's authority in constructing, enlarging or otherwise improving <br />water and power projects. The present law which Section 1 of SB 69 <br />would repeal and reenact reads as follows: <br /> <br />"The Colorado water conservation board may make available. <br />for the use of the citizens of the state of Colorado or to any agency <br />of the state which is, in its opinion, best able to utilize the same, <br />any or all water and power conserved by any of the projects to which <br />the state may have ownership or control and may enter into contracts <br />for the use of said water and ~der with any agency of the state, in- <br />dividuals, or with organizations composed of citizens of the state of <br />Colorado. The board may charge such person or agency or organization <br />using such water and power such charges as, in the opinion of the <br />board, are necessary and reasonable for the maintenance of the project <br />and return to the state such portions of the actual costs of the <br />project and over such term of years as is agreed upon by contract. <br />Any amount collected as charges over and above the amount necessary to <br />maintain any particular project and repay the cost of such project <br />shall become part of the Colorado water conservation board construc- <br />tion fund." <br /> <br />APPENDIX A <br />
