WILLIAMS: Mr. Chairman, I am Danny Williams, an Eagle county <br />cominissioner.' I would 'first like to apoligize to you and to the Board <br />for not "being present at the January meeting. We had, each:of us, " <br />some separate engagements that didn't allow us to make it at the 'last <br />minute. We do apologize for'~hat. <br /> <br />We have, subsequent to that time, had a meeting with the staff people <br />and the Division of Wildlife with regard to minimum streamflows.' I <br />have some specific concerns. All three county corrunissioners are here <br />tOday; and they may very well have different things to say to you'. , So <br />this is just for myself. <br /> <br />First of all," I have some 'co"ncerns in regard to the consitiutionality <br />question of SB 97: That puts me in a rather precarious position, <br />because I am asked to make corrunents to you in regard to these instream <br />flow requests arid not getting into the merits of the' case but under- <br />standing that there is a chance that it can go either way. It makes <br />it very difficult for me to endorse these appropriations when I realize <br />in my mind that it could well be :all in vain. So that is basically my <br />concern ,in regard to the constitutionality question. <br /> <br />I have another concern that in Eagle county we don't all of us, as <br />citizens, understand the importance and the complexity of 'the instream <br />flow appropriation bill and how it might affect the county and its <br />individual water user"s. I would request that the Board encourage the <br />Division of wildlife and the Department of Parks to conduct public <br />hearings in Eagle County in the future to allow the citizens to com- <br />prehend how the instream flow appropriations may affect them. <br /> <br />We, as county corrunissioners, have met with them and we have dealt with <br />the situation and have tiied to get a clear understanding; and we do I <br />represent the people, but there is controversy in Eagle County in <br />regard to this question. We thihk that it would be incumbent on you, <br />since you are making the appropriations, to hold some local public <br />hearings. <br /> <br />M~st important to me is that we have, in Eagle county, a continuing <br />need to change the use, of our water from its present basic agricultural <br />use to uses that will allow us to develop the diversified economic <br />growth our county feels is necessary.
