Walker
Deputy Director

TO: Members, CWCB

FROM: Bill McDonald

DATE: NOvember 5, 1984

SUBJECT: Agenda Item 10c, November 15, 1984, Board Meeting--
Informational Items, Instream Flow Program

Resolution of Wet Mountain Valley Cases

On June 3, 1982, the Board gave final approval to a number
of instream flow recommendations in Water Division 2 and filings
for water rights were made in the Water Court. Subsequently, .
Statements of Oppostion were filed by the Upper Arkansas Water
Conservancy District (UAWCD).

In an effort to address the objections raised by the UAWCD,
several meetings were held among CWCB staff, the UAWCD board,
individual members of that board, and the Division of wildlife.
As a result of these meetings, the analysis of new data, and the
re-evaluation of existing data, adjustments to a number of the
appropriated flows and reach termini were recommended. These
recommendations were approved by the Board at its November 3-4,
1983, meeting and transmitted to te UAWCD board for its
consideration.

A number of conversations and follow-up meetings, including
a referee's hearing, have been held in an attempt to resolve this
matter with the UAWCD. However, it wasn't until recently, when
Board member John Covert met with the UAWCD board, that the
District agreed to sign the proposed referee's rulings, thus
clearing the way for the Board's decrees. Referee's rulings have
been issued and decrees are expected shortly.

212 .
ai/wmvc
