<br />, . <br /> <br />Green Mountain Reservoir EIS/Division 5 ISF Recommendations <br /> <br />. <br /> <br />A number of preliminary instream flow recommendations in <br />Summit County were presented to the Board at its September 14, <br />1984, meeting for informational purposes. At that time the Board <br />agreed with the staff recommendation that no final action would <br />be taken by the Board until the environmental assessment for <br />Green Mountain Reservoir water sales was completed. The staff <br />was then instructed to cooperate with the Bureau of Reclamation, <br />the River District, and other involved entities in resolving any <br />technical issues with respect to the Board's instream flow <br />recommendations. <br /> <br />The Bureau has acknowledged the Board's request to be a <br />cooperating agency. The staff has attended public and agency <br />scoping meetings which were held by the Bureau to solicit <br />comments to help identify significant environmental issues <br />associated with revising the operating policy for Green Mountain <br />Reservoir. <br /> <br />To date the study is progressing on schedule. The River <br />District has contracted with Resource Consultants, Inc., to <br />perform the study and a work plan has been finalized. The <br />consultant is now working with the Bureau on computer modeling <br />and with the Division of wildlife on field data collection. The <br />draft EIS is scheduled for completion in April, 1985, and the <br />Final EIS in November, 1985. <br /> <br />. Resolution of Case No. 7-83CW144, Westfork Development, Ltd. <br /> <br />On November 2, 1984, Assistant Attorney General Steve Shupe <br />signed a consent decree and stipulation in the above referenced <br />case as previously authorized by the Board. The signed consent <br />decree was the eleventh draft representing numerous hours of <br />negotiations with the applicant to insure the Board's instream <br />flow decrees were adequately protected from injury. <br /> <br />The Board ratified the Statement of Opposition filed by the <br />staff in this case at its March 15, 1984, meeting to protect its <br />instream flow rights on the West Fork of the San Juan River in <br />the vicinity of Wolf Creek Pass. Concerns for potential injury <br />centered around the use of historic irrigation water rights to <br />augment wells which would service a four-season recreational <br />development including a major winter sports area with snowmaking <br />capabilities. <br /> <br />Highlights of the consent decree which speak directly to the <br />protection of the Board's insteam flow decrees include: <br /> <br />. <br /> <br />1) The applicant will cause two continuous recording stream <br />gages to be installed (by USGS) on the two stream <br />segments in question.
