L. and Dewanna L. Gray <br /> <br />At its July 13, 1984, meeting, the Board ratified the <br />Statement of Opposition filed in this case by the staff. The <br />application involved a pian of Augmentation on Gold Creek in <br />Gunnison County. At the time, the Board staff and the Division <br />Engineer had several questions regarding historic use of the <br />proposed augmentation water. Before the staff could make any <br />judgements as to the degree of injury it was necessary that the <br />questions of historic use be answered. <br /> <br />The investigation into the historic use of the proposed <br />augmentation water was carried out by the Division Engineer and <br />his staff with the results reported in the Division Engineer's <br />consultation report to the Referee. The staff has now received <br />and reviewed the consultation report and agrees with the Division <br />Engineer's conclusion that there has been adequate use of the <br />augmentation water. Further, the staff agrees that the applica- <br />tion, granted with the Divison Engineer's conditions, will <br />not materially injure the Board's instream flow right on <br />Gold Creek. <br /> <br />Staff Recommendation: <br /> <br />The staff recommends that it be authorized to withdraw the <br />Board's Statement of Opposition in this case. <br /> <br />/bvm <br /> <br />718 <br />pc/kl <br />
