We have lived near Miner's Creek for over 10 years and have enjoyed the <br />natural and pristine setting Miner's Creek provides just outside the Town of Frisco. Brook <br />trout and some brown trout swim up out of Bill's Ranch Lake into a series of beaver ponds <br />near our house, then up into the National Forest above Rainbow Lake. This is exactly the <br />kind of natural environment the instream flow program was created to protect. Please do <br />not compromise this unique and healthy stream system just to enable more development or <br />snow making in the Blue River drainage where historic placer mining and acid mine <br />drainage have made a mess of the Blue River. <br /> <br />Miner's Creek is basically a series of meadows and beaver ponds connected by short e <br />reaches of the creek. This pattern stretchs well into the upper reaches, even above the <br />Colorado Trail crossing. In the fall when the fish move out of these ponds there is just <br />enough water to provide passage into their spawning gravels. It is hard to imagine any <br />mitigation that would still allow this migi'ation with any less water flowing in the creek. <br />. We encourage you to do field studies to confirm impacts prior to making a decision to allow <br />any injury to the minimum stream flow filing. <br /> <br />Bill's Ranch Homeowner's Association was concerned about this situation and hired an <br />attorney to sort out water rights in the neighborhood. After spending aU of our association <br />dues we still don't have a clear picture of the local water rights situation. As a group of <br />long time residents confronted by powerful interests, we believe we have water rights that <br />will be injured but need more time to fully explore this concern.
