regulations.

4.1.3 Board of Adjustment

There will be established (if it does not already
exist) a Board of Adjustment with powers and
duties provided by (Title 30, Article 28,
Sections 117 and 118--Counties, Title 31, Article
23, Section 307--Municipalities) CRS 1973. The
Board of Adjustment may grant variances from the
provisions of these regulations and receive appeals
for permits denied by the Administrator or Permit
Authority. It may uphold denials of permit by
the Administrator or Permit Authority, or
overturn denials and grant the permit.

4.2 Floodplain Development Permit

4.2.1 Requirement to Have A Permit

Floodplain Development Permits will be required
for any development within a Floodprone,
Floodfringe, or Floodway District and shall be
issued by the Administrator, Permit Authority, or
Board of Adjustment upon compliance with the
terms of this regulation.

4.2.2 Application Requirements

The applicant is to provide a detailed
description of the proposed floodplain
development as required on the Floodplain Permit
Application. See Appendix A.

4.2.3 Standards for Floodplain Development Permit
Approval

In passing on an application for a Special Review
Use Permit, the Administrator or the Permit
Authority shall determine the specific flood
hazard at the site and shall evaluate the
suitability of the proposed use in relation to
the flood hazard. In addition, the Administrator
or the Permit Authori ty shall consider the
following factors, al though not limited to such
factors.

(1) The probability that materials may be swept
onto other lands or downstream to the injury
of others.
