<br />and granting or denyinq Floodplain Development <br />Permi ts pursuant to the terms of these <br />regulations. <br /> <br />4.1.3 Board of Adjustment <br /> <br />There will be established (if it does not already <br />exist) a Board of Adjustment with powers and <br />duties provided by (Title 30, Article 28, <br />Sections 117 and 118--Counties, Title 31, Article <br />23, Section 307--Municipalities) CRS 1973. The <br />Board of Adjustment may grant variances from the <br />provisions of these regulations and receive appeals <br />for permits denied by the Administrator or Permit <br />Authority. It may uphold denials of permit by <br />the Administrator or Permit Authority, or <br />overturn denials and grant the permit. <br /> <br />4.2 Floodplain Development Permit <br /> <br />4.2.1 Requirement to Have A Permit <br /> <br />Floodplain Development Permits will be required <br />for any development within a Floodprone, <br />Floodfringe, or Floodway District and shall be <br />issued by the Administrator, Permit Authority, or <br />Board of Adjustment upon compliance with the <br />terms of this regulation. <br /> <br />4.2.2 Application Requirements <br /> <br />The applicant is to provide a detailed <br />description of the proposed floodplain <br />development as required on the Floodplain Permit <br />Application. See Appendix A. <br /> <br />4.2.3 Standards for Floodplain Development Permit <br />Approval <br /> <br />In passing on an application for a Special Review <br />Use Permit, the Administrator or the Permit <br />Authority shall determine the specific flood <br />hazard at the site and shall evaluate the <br />suitability of the proposed use in relation to <br />the flood hazard. In addition, the Administrator <br />or the Permit Authori ty shall consider the <br />following factors, al though not limited to such <br />factors. <br /> <br />(1) The probability that materials may be swept <br />onto other lands or downstream to the injury <br />of others. <br /> <br />-16- <br />
