<br />. <br /> <br />. <br /> <br />. <br /> <br />5 <br /> <br />a, The annual average yield of the Fish Pool is 5.650 acre- <br />feet, <br /> <br />b, A full yield of 6.000 acre-feet is available to the Fish <br />Pool in 27 of 33 years. <br /> <br />4, The Fish Pool water stored as provided herein shall be <br />released at the discretion of the Service, The protection <br />of the releases will be accomplished pursuant to the terms <br />of a separate agreement between the River District and the <br />CWCB (herein referred to as the CWCB MOA) which shall <br />provide for the delivery and protection of that water <br />instream to and through the Subject Reach pursuant to the <br />Section 7 Enforcement Agreement between CWCB and the <br />Service, <br /> <br />5, <br /> <br />The Service will notify the River District and CWCB <br />annually. no later than July 15. of its requested initial <br />pattern of delivery of the Fish Pool water to the Subject <br />Reach. Thereafter. the Service will notify the River <br />District and CWCB as soon as possible by phone or by fax of <br />any changes to the pattern of delivery to the Subject Reach. <br /> <br />6. The Fish Pool releases to the Subject Reach will be made <br />during the period from March 1 through December 1 annually <br />as requested by the Service pursuant to the CWCB MOA. The <br />releases of the Fish Pool water will be limited to a maximum <br />of 200 cfs based upon channel capacity constraints <br />established by the River District. Releases from the Fish <br />Pool will be measured at a U.S. Geological Survey gage below <br />the outlet works of Wolford Mountain Reservoir <br /> <br />7. The Service agrees to coordinate releases during the months <br />of July through October with releases it will be requesting <br />from Ruedi Reservoir. The Service will give priority to <br />delivery of Fish Pool water at times when Ruedi releases to <br />the Subject Reach would cause locally unacceptable flow <br />conditions on the Fryingpan River below Ruedi Reservoir, <br /> <br />B, <br /> <br />The Bureau of Land Management shall include a condition in the <br />Permits for Wolford Mountain Reservoir enlargement that will <br />state: "If in the future the River District does not provide 10 <br />percent of the storable inflow to the Fish Pool (provided that <br />space exists in the Pool) in any given year the Service may re- <br />initiate section 7 consultation on Wolford Mountain Reservoir <br />
