The River District will continue to participate, through operation. <br />of Wolford Mountain Reservoir and technical support in the <br />Recovery Program coordinated reservoir operations project as <br />described in the Recovery Implementation Program Recovery Action <br />associated Scope of Work; provided that such participation can be <br />accomplished under Colorado law and water rights administration in <br />a manner that does not aiminish the yield of Wolford Mountain <br />Reservoir. including th~ Fish Pool. <br /> <br />E. <br /> <br />This MOU replaces and supersedes the original MOU signed February . <br />7. 1990. <br /> <br />V, Term and Termination: <br /> <br />This MOU is intended to provide a reasonable and prudent alternative for the <br />Biological Opinion for Wolford Mountain Reservoir and as such will remain in <br />place subject to the following terms and conditions: <br /> <br />A. The River District shall provide the Fish Pool water to the <br />Service as long as it continues to be determined by the Service <br />that carrying out this MOU will satisfy the reasonable and prudent <br />alternative as described in the Wolford Mountain Reservoir <br />Biological Opinion dated <br /> <br />B. At any time during the term of the MOU. if the River District <br />acquires an alternate source of water for the Wolford Mountain <br />Reservoir Fish Pool which is deliverable to the Subject Reach. the <br />River District, with the Service's concurrence. can substitute <br />such water for.Wolford Mountain Reservoir Fish Pool water. <br /> <br />C. <br /> <br />If and when the Service determines and notifies in writing that . <br />water is no longer needed from Wolford Mountain Reservoir Fish <br />Pool for the recovery of listed native fish species in the Subject <br />Reach, the River District's obligations under this MOU shall <br />
