',j

When the Bureau of Reclamation (Bureau) built the Gunnison
tunnel and the Uncompahgre irrigation project. it also,
purchased the then existing canal system in the area; these
canals were built in the late 1800's and early,:1900's.

The' Bureau operated the system until about ,1932 ,when it
transferred the operation. maintenance. and replacement of the'
project works to the Uncompahgre Water Users' Association. a
Colorado non-profit association. ",.

.

Sometime in 1982 the Bureau determined, that three of the
canals of the project were eligible for nomination to the
National Register. since they were built over,50 years ago.

The Colorado Historical Society'(CHS).later,became
interested and has determined that the canals are eligiple for
inclusion in the National Register of historic places. This
iriclusion would mean that 100 teet,~n either side of the canal
would become part of the required right-of-way. This would
present a problem with the landowners since they own all the
adjacent land. inCluding the land under the canal. Even though
the landowners were notified about the inclusions. it is
doubtful that the 50 percent or more of them required by
statute would be in favor of including the canals in the
National Register.

The landowner's concern stems from the following factors:'

1. When maintenance of the canal or repair to canal
structures is necessary. a 30-day review by CHS will be
required.

.

-4-
