197

Mr. Bailey: Let us refer back to the Engineering Contract.

At this point, Governor Thornton came in to say hello and to
welcome the new members, and spoke briefly to the Board.

1

5. Consulting Engineer Contract.

Follo, ving the Governor's appearance, page )a of the engineer-
ing contract was read.

Mr. Moses: I move the approval of the engineering contract.

Mr. Hinderlider: I asked Mr. Hill if he or any memb~r of his
firm was registered as a professional engineer of this State.
Neither he nor any member of his firm is registered. Th~s contract
says it is to be governed by the laws of Colorado. I have the
highest regard for Mr. Hill but I think this situation a~fects this
Board because he will have to be registered before he can perform
any service in this state. The Yrofessional Engineer Examining
Board meets every two months but I do not know the date of the next
meeting. We could call an emergency meeting; since this is an
emergency, we could call a meeting and approve Mr. Hill's regis..
tration.

Mr. Tipton: How long can a non-registered out-of-state engineer
practice in the state before he has to be registered?

Mr. Hinderlider: 30 days~

Mr. Bailey: Is there anything in this situation that can pre-
vent the Board from approving the contract?

Mr. Hinkley: Of course, Mr. Hill will have to comply with the
law but there is nothing against approving the contract now.

Mr. Hinderlider: If this Board enters into contract with Mr.
Hill, they make an obligation to pay for his services. If Mr. Hill
is not registered the Board may have to pay him.

Mr. Breitenstein: Is there no reciprocity or any other way
whereby we can get around t~is?

Mr. Hinderlider: No, someone in 'the firm must be registered
in the State,

I

Mr. Dutcher:
taken up after the

Is not that a routine matter that should be
contract is approved?

Mr. Hinderlider: I am not qualified to say, not being an
Attorney. I am just saying it should be considered by the Board.

Mr. Breitenstein: The Civil Service Amendment to the Consti-
tution clearly contemplates such things as this. I think the con-
stitution recognizes it as it is.
