<br />197 <br /> <br />Mr. Bailey: Let us refer back to the Engineering Contract. <br /> <br />At this point, Governor Thornton came in to say hello and to <br />welcome the new members, and spoke briefly to the Board. <br /> <br />1 <br /> <br />5. Consulting Engineer Contract. <br /> <br />Follo,ving the Governor's appearance, page )a of the engineer- <br />ing contract was read. <br /> <br />Mr. Moses: I move the approval of the engineering contract. <br /> <br />Mr. Hinderlider: I asked Mr. Hill if he or any memb~r of his <br />firm was registered as a professional engineer of this State. <br />Neither he nor any member of his firm is registered. Th~s contract <br />says it is to be governed by the laws of Colorado. I have the <br />highest regard for Mr. Hill but I think this situation a~fects this <br />Board because he will have to be registered before he can perform <br />any service in this state. The Yrofessional Engineer Examining <br />Board meets every two months but I do not know the date of the next <br />meeting. We could call an emergency meeting; since this is an <br />emergency, we could call a meeting and approve Mr. Hill's regis.. <br />tration. <br /> <br />Mr. Tipton: How long can a non-registered out-of-state engineer <br />practice in the state before he has to be registered? <br /> <br />Mr. Hinderlider: 30 days~ <br /> <br />Mr. Bailey: Is there anything in this situation that can pre- <br />vent the Board from approving the contract? <br /> <br />Mr. Hinkley: Of course, Mr. Hill will have to comply with the <br />law but there is nothing against approving the contract now. <br /> <br />Mr. Hinderlider: If this Board enters into contract with Mr. <br />Hill, they make an obligation to pay for his services. If Mr. Hill <br />is not registered the Board may have to pay him. <br /> <br />Mr. Breitenstein: Is there no reciprocity or any other way <br />whereby we can get around t~is? <br /> <br />Mr. Hinderlider: No, someone in 'the firm must be registered <br />in the State, <br /> <br />I <br /> <br />Mr. Dutcher: <br />taken up after the <br /> <br />Is not that a routine matter that should be <br />contract is approved? <br /> <br />Mr. Hinderlider: I am not qualified to say, not being an <br />Attorney. I am just saying it should be considered by the Board. <br /> <br />Mr. Breitenstein: The Civil Service Amendment to the Consti- <br />tution clearly contemplates such things as this. I think the con- <br />stitution recognizes it as it is. <br />
