<br />206 <br /> <br />. l"r. Beaty: I move the Board approve Glenn Saunders for Mr. <br />Petry; Simon Elliot for H. H. Christy, Senator Lew Williams for <br />Geo'rge Cory and Frank Merriell for Robert Delaney, and I include a <br />ratif;ication of actions participated in by ~IT. Saunders and <br />Mr. Merriell on the Committee previous to this time. <br /> <br />Mr. Dutcher seconded the motion and it was carried. <br /> <br />I <br /> <br />Mr. Dutcher: Alternates should be notified. of meetings of <br />~he Conference Committee and should attend each meeting. Then they <br />can fill right in. <br /> <br />Mr. Bailey: That is what should be done. They should attend. <br /> <br />Mr. Moses: The report on Wagon Vfueel Gap has been sent out. <br />Does the Board take any action on it. <br /> <br />18. Ground water Committee. <br /> <br />Mr. Breitenstein: The Governor has directed the Board to <br />comment on such rna tJ:,ers. The Board will remember the discussion of <br />ground water legislation. Stone set up two committees to study that <br />problem. Air. Tipton was chairman of the engineering phase and <br />McHendrie, Chairman of the legal committee. Board decided, after <br />Stone's death these matters should be held in abeyance. The activity <br />was not an ~ctivity of this Board, it was an outside thing. After <br />Stone's death, I received notice from McHendrie to attend a meeting <br />of the legal committee. I told him I was iaformed by the-Board not <br />to attend a meeting because the Board ~ms holding it in abeyance. He <br />was not happy about it.. I raise the question because I wonder if the <br />Board wantq to clarify its position on it for the future. <br /> <br />Mr. Saunders: This bad legislation that was passed, I feel <br />unhappy about it. It does not touch the trouble except for licensing <br />the well drillers. About 8 years ago a water bill was drafted and <br />presented to the Water Board. Sinoe that time a committee has done <br />some work on this. They came up with some ideas and facts. Those <br />ohanges in suggested law have not as yet been formulated into a bill. <br />I .think this bill that was passed might have been stopped -if we had <br />had a bill ready, but we didn't. We must not make the mistake of <br />giving the Director any more than he can do, but unless the Board <br />takes some action on this question we are going to be very bad off. <br /> <br />Mr. Dille: You think the next session of legi;lature might <br />repeal this bill and substitute some other legislation? <br /> <br />Mr. Saunders: I do. I think Senator Hazard put his bill <br />through because he did not have anything better. I think the Attorney <br />General has advised Mr. llinderlider to aooept a filing but when it <br />comes to adjudication I think they are on thin ice. <br /> <br />1 <br /> <br />Mr. Williams: In Arizona it was declared unconstitutional; is <br />it working in California and the other states? <br />
