<br />5.9.3 Low Hazard dams shall have weirs, flumes or other measuring devices installed, as <br />approved by the State Engineer, to allow monitoring and measurement of leakage through <br />the embankment or foundation. <br /> <br />5.9.4 NPH dams are not required to have instrumentation other than gage rods in <br />accordance with Rule 5.9.1. <br /> <br />5.10 Cost Estimate - A detailed cost estimate of the construction of the dam including the <br />engineering fees. The cost estimate will remain confidential until after the construction contract is <br />executed. <br /> <br />5.11 Fees - A filing fee of$3.00 per $1,000 (or fraction thereof) ofthe cost estimate, limited to a <br />maximum of $3,000.00, with a minimum filing fee of $1 00. <br /> <br />5.12 Approval Limitation - If construction, alteration, or repair of a reservoir dam is not <br />commenced within five years of approval of the application, the State Engineer's approval shall be <br />void. The owner must resubmit the application and receive approval before commencing <br />construction, and shall meet the requirements of the current Rules and Regulations. <br /> <br />5.13 Approval of Plans and Specifications - Acceptable plans and specifications will be certified <br />by the State Engineer or designee and approved for construction. <br /> <br />Rule 6. Requirements for Alteration. Modification or Repair of an Existine Dam: <br /> <br />6.1 An owner proposing to alter, modify, or repair an existing dam shall submit an application <br />package in a form acceptable to the State Engineer and receive approval of the construction plans <br />and specifications from the State Engineer prior to construction. The provisions of Rule 6 shall <br />apply to such application only to the extent directly related to work for which approval is being <br />sought. <br /> <br />6.1.1 Design Requirements - The requirements of Rule 5 shaIl apply except as modified by <br />Rules 6.1.2 and 6.1.3. A Hydrology Report, Geotechnical Report, Design Report and <br />Instrumentation Plan are required as a minimum to support the scope of the work described <br />on the application. <br /> <br />6.1.2 Application and Approval Requirements for High Hazard, Significant Hazard <br />and Large Low Hazard Dams - Plans for repair of an existing dam, or alteration of <br />existing High Hazard, Significant Hazard and Large Low Hazard dams to non-jurisdictional <br />size may be approved by the State Engineer by letter without meeting requirements set forth <br />in Rule 5.2 and 5.3, subject to the following conditions: <br /> <br />6.1.2.1 A completed application form provided by the State Engineer shall <br />accompany appropriate specifications and necessary drawings depicting minimum <br /> <br />24 <br />
