<br />674 <br /> <br />affected localities, and other means readily at hand, and <br />after a hearing, on notice, held within the proposed "Ten- <br />tatively Critical Ground-Water District", it shall desig- <br />nate, as "Tentatively Critical Ground-Water Districts", any <br />areas where, from the information.gathered, the withdrawal <br />of ground water appears to have reached or exceeded the <br />normal annual rate of replenishment. The Water board <br />shall recognize the possible occurrence of two or more <br />superimposed aquifers within a district which are geologi- <br />cally or hydrologically unrelated. <br /> <br />I <br /> <br />When such a condition occurs within a district, <br />the Water board shall designate such to be critical and <br />fix the tentative boundaries accordingly. Boundaries of <br />designated districts shall consist of land survey lines, <br />highways, county roads, railroads and readily recognizable <br />natural boundaries which can be definitely and clearly <br />described. All surface boundaries are to be as consistent <br />as may be reasonably possible witb known or evident hydro- <br />logical or geological boundaries. <br /> <br />The Water board shall immediately close all areas <br />designated as Tentatively Critical Districts to further de- <br />velopment of groundwater resources. Publication of an <br />official notice of the action taken ~hall be made in a <br />newspaper of general circulation within each county in the <br />designated district if one be published therein. The State <br />Engineer shall refuse to issue permits for new wells in any <br />such designated district, except for domestic use as speci- <br />fied in section 147-18-10, or except to deepen, replace or <br />reconstruct wells which have been in operation for more <br />than one year prior to the effective date of this Article, <br />to the extent that such is necessary to restore the produc- <br />tive capacity of such a well. <br /> <br />As soon as reasonably sufficient data and inform- <br />ation have been obtained and considered, but within one <br />year from the effective date of this Article, the Water <br />board shall review all areas designated as tentatively <br />critical along with any other areas which may be in ques- <br />tion and designate and bound all areas which are to be <br />indefinitely closed to further development of ground water. <br />The Water board shall publish notice thereof in some news- <br />paper of general circulation within each county in the dis- <br />trict or districts if one be published therein. Any publi- <br />cation provided in this Article shall be for three suc- <br />cessive weeks, unless otherwise provided. <br /> <br />I <br /> <br />The Water board may, at the end of any two year <br />period after the designation of any restricted district, <br />
