Consent Agenda <br />Tape 1, Start/Stop: 2100 - 2208 <br />Action: A motion was made by Patricia Wells and seconded by David Smith to approve <br />the consent agenda, and to add Jennifer Gimbel's (AG's office) request that the <br />Floodplain Recommendations under Consent Agenda item 4-3 a. through d., <br />include within the recommendation language that it be "subject to local <br />governments requiring a detailed study prior to development of activities in <br />those areas." (This language was used in the review of the recommendation but <br />was not included in the original "staff recommendation to the Board.") The <br />motion was approved unanimously (10-0). <br /> <br />5a. Stream and Lake Protection - Injury with Mitigation/Pre-existing Undecreed Use <br />Tape 1, Start/Stop: 2330 - 4088 <br />Action: A motion was made by Patricia Wells and seconded by David Smith to accept <br />the staff recommendations that the Board not ratify the Applicant's current <br />proposal for proposed Injury Accepted with Mitigation. A comment was made <br />by Greg Walcher regarding the CWCB staff's concerns and those of the Rio <br />Grande Water Conservation District. It was noted that those concerns need to <br />be addressed before giving any consideration to future proposals by the <br />applicant. The motion was approved unanimously (10-0). <br /> <br />6a. Stream and Lake Protection - Authorization to Proceed to Trial <br />Tape 1, Start/Stop: 4088 - 4275 <br />Action: A motion was made by David Smith and seconded by Eric Wilkinson to <br />accept the staff recommendation that the Board authorize Staff to proceed <br />to trial in Case No. 96CW014 to protect CWCB's instream flow water <br />rights on Tarryall, Michigan, and Jefferson Creeks. The motion was <br />approved unanimously (10- 0). <br /> <br />7a. Executive Session Briefing <br />Tape 1, Start/Stop: 4275 - 5069 <br />Action Patricia Wells announced her intention to recuse herself from the <br />Executive Session. A motion was made by David Smith and seconded by <br />Patricia Wells to adjourn to Executive Session.
