<br /> <br /> <br />services to be assessed against the"parties to the suit as follows: <br />Nebraska $15.000; Wyoming $15.000; Colorado $5.000 and the United <br />States $10.000. This order further provides that the sum of $4.368.51 <br />shall be paid in equal proportions by the parties to the suit for the <br />disbursements made by the Master while engaged in this litigation. He <br />further explained that it was not known what the actual Court cost <br />w~ould be but estimated that Colorado's share would probably be from <br />$400 to $500. These Court costs by the Court order were apportioned <br />one-fifth to Colorado. two-fifths to Nebraska andtwo~fifths to Wyom- <br />ing. Ee reconunended that the sum of $6.092.1.3 be sent to the Clerk of <br />the Supreme Court to pay the Master's fees and disbursements and that <br />if it can be arranged. a warrant be secured for an additional $l:iOOor <br />$500 before the end of the biennium to be used in the nature of a de- <br />posit for Colorado's share of the Court cost in this case. <br /> <br />After discussion of the recommendations made by the At- <br />torney for the Board. J. M. Dille presented the following re~ <br />solution and moved its passage: <br /> <br />P.ESOLUTION <br /> <br />WHEREAS. on the lath day of June A. D. 1945. the Supreme <br />Court of the United States in the case of the State of Neb- <br />raska. Complainant, vs. The State of Wyoming, Defendant. The <br />State of Colorado, Impleaded Defendant, The United States of <br />America, Intervener. entered the following order: <br /> <br />"On consideration of the statement of the <br />Special Master, <br /> <br />"n IS ORDERED that Michael J. Doherty. Es- <br />quire. of Saint Paul. Minnesota, be and he hereby <br />is, awarded the SUIll 0 f $45,000 as compensation <br />for his services as Special Master in this cause. <br />and~that his disbursements totaling $4.368.51 be <br />allowed. and <br /> <br />"IT IS FURTHER ORDERED that the compensation <br />awarded to the Special Master herein shall be paid <br />by the parties in the following proportions: The <br />State of Nebraska. $l5.000; The State of Wyoming. <br />$15.000; The State of Colorado, $5,000 and The <br />United States. $10.000. The disbursements of the <br />Special Master allowed herein shall be borne in <br />equal shares by the States of Nebraska. Wyoming <br />and Colorado and the United States." <br /> <br />AND WHEREAS. the State of Colorado, pursuant to the above <br />quoted order. is obligated to p ay the sum of $5.000 to Michael <br />J. Doherty, Esquire. as a portion of his compensation as <br />Special Master in the above entitled case, and the sum of <br />$I,092.13 as the State's share of disbursements of such Spe- <br />cial Master while engaged in the above case; and <br /> <br />
