EAKES: <br /> <br />1783 <br /> <br />"Well, of course, a compact would be more <br />desirable but it's out of the question insofar <br />as holding up this legislation. We just can't <br />do it, we haven't the time. We have no alter- <br />native. I think we have to realize that every- <br />thing in Colorado would also have to come to a <br />halt; that New Mexico is not going to stand still <br />for another two or three years of negotiations <br />on this particular problem. That's self-evident. <br /> <br />Legislation can of course, be amended at <br />some future date. At some future date it may be <br />that we may agree that it can be amended but I <br />seriously doubt if this legislation can ever be <br />amended, or any legislation either amended or <br />passed in the upper basin, unless the four states <br />agree on it. It would be very, very difficult. <br />I fully agree that a compact would be more desir- <br />able, assuming that we don't make the same mis- <br />takes that we made in our other compacts. None <br />of us here are smart enough today to figure this <br />thing out in all its ramifications. We will just <br />do the best we can. We can't be critical of the <br />people who in the past negotiated compacts be- <br />cause they took the facts before them and they <br />were the most competent people we had available. <br /> <br />I think as a practical matter the compact is <br />out unless something can be brought in, in the way <br />John Barnard suggested - John Barnard, Jr. - <br />that it be subject to future compact. I think <br />even as a practical matter that that could not <br />be accomplished with the State of New Mexico. <br />We are working wit~ a practical situation.
