Why don't I look at...in places where I think we have modified,
and I probably missed some...In my motion, what modifies what's here...on
page 7, I c, the amount claimed is not the amount in the final notice but
is the Wildlife/Staff recommendation that we've received today. And 2c,
the flow remaining after the carveout, we want to add the reserving the
right to quantify the flows as appropriate. In 3f, on page 8, we agree to
change "determined by the Board" n the three places where it occurs to
"acceptable to the Board"..

I'm sorry...3f?

Yes, in the middle of page 8, with the modifiability...In g...

Where does the word go, then?

It says "being modifiable in amounts determined by the Board"...since
Wendy recommended that we say "acceptable to the Board". Then in g,
there's several changes in...

In g you restated, I thought rather well...and we just need to make sure
we've got that down... you have that written there, right?

e

Yes.

And that is the modification criteria? Would you just buzz through that?

"In determining whether to increase the carveout, the Board shall base its
decision on whether and to what extent failure to modify would deprive
the people of Colorado of the beneficial use of water available under
interstate compacts, and whether and to what extent modification would
continue to preserve the environment of the listed fish species to a
reasonable degree. The decree to be entered in this case shall set forth the
criteria and procedure for modifying for increasing the carveout."

I'm wondering about... that's pretty good. I just...I wonder about the extent
needed to protect..to preserve the natural environment to a reasonable
degree, including particularly the environment of the fish...I want to stay
pretty close to our general standard.

So rather than put environment of the fish, you would say preserve the
environment to a reasonable degree...

e

Minutes of December 13, 1995 Special CWCB Meeting
