<br />- 3- <br /> <br />. <br /> <br />7) <br /> <br />EASEMENT APPLICATION - The applicant and/or agent have complied \vith the provisions of <br />the eWCB's most current Easement Guidelines for the Chatfield Downstream Channel <br />Improvement Project. <br /> <br />Easement and Fcc Considerations <br />eWCB Procedures for computing casement fees for the eWCB South Platte River Right of \Vay arc <br />based on three dilTcrent methods. Method I is the Market value method. Method II is the Impact Method. <br />and Method III is the Special Use Consideration. A site survey shows that 6.25 acres is requested for the <br />easement. which is equivalent to 272.250 square feel of eWCB ROW. Rather than using method II, <br />staff recommends the use of Method III in this case (assumes the revised Method III if agenda item 11 is <br />approved by the Board). Due 10 the large size of the casement request. maintenance offered by the <br />Applicant. and other considerations. staff recommends a fee based on the Special Use Consideration. <br />StafT recommends in this case a llat fee of 575.000 that would represent a fair and reasonable fee for the <br />subject easement request. That amount would give credit to the Applicant for 25 years worth of <br />maintenance on said casement and adjacent areas. along \....ith other considerations such as beautification <br />and enhancement of otherwise fallow and inaccessible lands. <br /> <br />. <br /> <br />RECOl\Il\IE~DATION <br />Following a review by the AG's Office and CWCB stafT for Agenda Item 12. stafT recommends that the <br />Board: <br />Approve the constmction easement and non-exclusive casement request for Columbine Country <br />Club (Golf Course rcconstmction) located in Columbine Valley. Colorado. The easement is <br />located on CWeB right-of-way and the casement fee shall be 575.000 using Method III (Special <br />Use Consideration) plus the 5500 casement application fee. Other considerations shall include <br />standard contract language plus obligations by the Applicant for maintemmee activities for the <br />entire duration of the casement period. The Board authorizes stafT to prepare the necessary <br />casement documents and authorizes the Director to execute said documents.
