<br />- 2- <br /> <br />. <br /> <br />(2) Columbine offered to maintain the land in the subject casement area, and areas adjacent to the <br />easement on the \o,.'csl bank of the South Platte River; <br />(3) The casement request is entirely outside of the I DO-year floodplain; <br />(4) Columbine has agreed to only put golf greens and a cart path on the C\VCB land. Buildings or <br />other stmclurcs will not be allO\\'cd in this easement; <br />(5) Columbine has received verbal approval from the Corps. and will receive an actual pennit in <br />the near future. for a temporary road crossing of Dutch creek during construction; <br />(6) Columbine \vill not disrupt or block the District's maintenance access along the river. and the <br />easement "'ill be set back approximately 25 feel from the lOp bank of the river; <br />(7) Columbine's request is for an acceptable open space activity suitable for floodplain corridor <br />use. and incorporates stewardship and appreciation for maintenance of the C\VCB lands along <br />the SOllth Platte River. <br /> <br />The staff linds Ihat these uses can \vork in hannony \....ithin the C\VCB project right-of-way \vith certain <br />subordination requirements and special constmclion considerations. which must be stated in the easement <br />agreement. <br /> <br />The project perfom13ncc schedule is: <br />. Secure CWeB easement approval - Novcmbcr 2005 <br />. Execute eascmcnt agreement with CWCB ~ January 2006 <br />. Completion of golf course redesign - June 2006 <br /> <br />. <br /> <br />Conditions for the Easemenf - If the casement is grantcd. the owner shall comply with the follO\ving <br />condilions: <br /> <br />1) TIl\'1E PERIOD - The EASEMENT shall be for a teml 01'25 years and can be renewable. <br /> <br />2) PERMITS - The owner shall be responsible for sccuring and monitoring all required federal, stale, <br />and local permits pertaining to this easement request <br /> <br />3) INSURANCE COVERAGE - The eWCB shall be named as an additional insured, and shall have <br />coverage in Ihe amounts established by the Colorado Governmental Immunity Act - part one of <br />article 10 of title 24. lOa c.R.S.. as amended. <br /> <br />4) FEE CONSIDERATIONS - A recommendation will be made Ihal IS In compliance with the <br />C\VCB fee stmeture for this request as approved by the Board. <br /> <br />5) RECLAMA nON OF THE SITE - A reclamation plan and all site grading plan shall be <br />developed and pro\;ded 10 the eWCB for approval prior 10 the eonstmction and completion of the <br />project. <br /> <br />6) ;\,ON-EXCLUSIVE EASEME~T CLAUSE - Language will be stated in the casement that will <br />reserve the eWCB's right to grant additional casements on the same land covered by this <br />casement. <br /> <br />. <br /> <br />Flood PrO[~'Ctlon.
