Ray Wright made a motion to ratify <br />the staff action not to file statements of opposition. Dave Meyering seconded the motion, <br />The motion passed unanimously (10-0), <br /> <br />21. Instream Flow Program - Withdrawal of Statements of Opposition: Case No. <br />2-9290CW056; City of Colorado Springs" (5:03 - 5:05 p.m.) <br /> <br />22. <br /> <br />16a. <br /> <br />Dan Merriman reviewed the staff memorandum. Bob Jackson moved for approval of the <br />staff recommendation to withdraw the statement of opposition on Item 21a, City of <br />Colorado Springs. The motion was seconded by Janice Sheftel. The motion passed (9-1), <br />Tyler Martineau was not in favor. <br /> <br />Instream Flow Program - Rules and Regulations (5:05 -5:06 p.m.) <br /> <br />Dan Merriman gave a brief update and a schedule, A revised set of Rules and <br />Regulations will be given to the Board by mid - February. No action was taken. <br /> <br />Colorado River Issues - Seven Basin StateslIndian Tribes Negotiations" (5:06 - 5:19 <br />p.m.) <br /> <br />Jim Lochhead reported on discussion of the Memorandum of Agreement between the <br />Colorado River Indian Tribes and the States regarding the lease of Indian waters. The <br />states and tribes reached an agreement on a process to address these issues, including a <br />format for the negotiating process, I) purposes and parameters of the negotiations, 2) <br />agreement on who the parties to the negotiations would be; 3) establishing ground rules <br />for the negotiations; 4) agreement on a specific process. The group is to identify <br />reasonable consumptive uses over a defined period of time for California and Nevada, and <br />develop alternatives for meeting these requirements, The Indian tribes are to identify the <br />amount, type and location of water available as well as alternatives for making this water <br />available, and by the end of January, any other state(s) can identify alternatives for <br />satisfying anticipated reasonable consumptive use requirements of California and Nevada. <br />The next meeting will be in March, 1993 in Nevada. This is a formalization of the <br />process initiated by Governor Romer's original letter of February 1991. Procedural <br />processes were the only issues addressed. The Colorado River Advisory Council endorsed <br />Colorado's participation in this process, The Upper Basin States have initiated analysis <br />of operational alternatives to address the needs in Nevada and California. These <br />alternatives will be reviewed with the AGO, staff and the Upper Colorado River <br />Commission, and brought back to the Board for policy input and direction. David <br />Harrison made a motion to ratify the State's participation in the process outlined above. <br />The motion was seconded by Bob Jackson and passed unanimously (10-0). <br /> <br />17 <br />
