Dingell-Johnston Program. <br /> <br />. <br /> <br />With reference to item a. the staff had received an <br />inquiry as to the legality of the Board to apply fot a water <br />right under the instream flow program for scenic values; e.g.. <br />a water fall on the Animas River in La Plata County. <br /> <br />Mr. Vandemoer moved. seconded by Mr. Smith. that <br />the staff study this matter and report to the Board at a <br />subsequent meeting. Motion approved unanimously. <br /> <br />The Dingell-Johnston Act provides funds. on a <br />matChing basis. for the improvement of the nation's <br />sport-fishing facilities and fishery-management programs. In <br />1984. Congress passed legislation known as the Dingell-Johnston <br />Expansion Bill. This legislation provides increased revenues <br />for the D-J Program. Colorado's present allocation of $800.000 <br />could expand to $2.3 million. <br /> <br />The Division of Wildlife has proposed that a <br />significant portion of the D-J Expansion funds for new projects <br />by earmarked for the purchase of water rights to protect <br />instream flows in highly over-appropriated stream drainages. <br />Stemming from this proposal. a joint effort has been undertaken <br />by the staffs of the CWCB and the DOW to put together the <br />framework for a proposed state water rights acquisition program. <br /> <br />FOllowing discussion by Board members. Mr. McDonald ~ <br />recommended that the staff continue in developing a cooperative <br />program and present the final proposal to the Board for its <br />review and approval. <br /> <br />Aqenda Item 10 - Bear Creek Reservoir Space Allocation <br />- Appendix E <br /> <br />In his report on this item. Mr. McDonald recalled that the <br />Board members had discussed this item in the July and <br />September. 1984. Board meetings. Several entities had <br />expressed interest in obtaining storage space in both Chatfield <br />and Bear Creek Reservoirs. At the November meeting. the Board <br />received a proposal for the allocation of potentially available <br />space from the Central Colorado Water Conservancy District. No <br />specific actions were taken at the July or September. 1984. <br />meetings since the Corps' report on space availability had not <br />been received. <br /> <br />The Corps' study was received early in January 1985. just <br />several days prior to the Board Meeting. This preCluded a <br />chance to distribute it to and discuss it with interested <br />parties and for the staff to thoroughly analyze it in <br />consultation with the State Engineer. <br /> <br />. <br /> <br />-6- <br />
