Rapid Creek Mr. Vandemoer moved. seconded by Mr. Getches. that the Board ratify the Statement of Opposition filed on the Board's behalf and instruct the staff to continue working with the applicant to ensure that 2 cfs of the Board's original 4 cfs is protected from injury. Motion adopted unanimously. 2. Ratification of Stipulations a. Case No. 1-82 CW305 - Louisville. South Boulder Creek Mr. Vandemoer moved. seconded by Mr. Smith. that the Board ratify the proposed stipulation and authorize the staff to maintain the Entry of Appearance until such time as the stipulated decree is executed. Motion adopted unanimously. b. Case No. 1-80 CW468- City of Lafayette. South Boulder Creek . In its memorandum to the Board dated January 7. 1985. the staff had recommended that the Board ratify the proposed stipulation. expecting finalization of language by the time of the Board meeting. However. language had not been finalized prior to the meeting on January 14. 1985. and the staff recommended no action be taken and the proposed stipulation be tabled. Mr. Lochhead moved. seconded by Mr. Smith. that the case be tabled. The motion was adopted by unanimous vote. On the following day (January 15. 1985). Mr. Jeff Kahn of the Attorney General's staff recommended that the Board approve the concept of the stipulation and authorize the staff to work with the applicant and the State Engineer to finalize the precise language. If language agreeable to the applicant and the State Engineer can be firmed up. the Director will be authorized to sign-off for the Board. If no agreement can be reached. then the staff is authorized to proceed to trial. Mr. Vandemoer moved. seconded by the Board accept Mr. Kahn's recommendation. adopted unanimously.
