Subordination to the water rights of the Colorado <br /> <br /> <br />Water Conservation Board, decreed in Case No. 80CW379, <br /> <br /> <br />District Court, Water Division 1. <br /> <br />. <br /> <br />Diversions of water made by the applicant under this change <br /> <br /> <br />of water right adjudication, when made at the points of <br /> <br /> <br />diversion described in paragraphs lla, lIb, llc, lId, lIe, <br /> <br /> <br />Ilf, Ilg, Ilh shall be administered as being subordinate <br /> <br /> <br />(junior in priority) to the instream flow water right of the <br /> <br /> <br />Colorado Water Conservation Board on behalf of the People of <br /> <br /> <br />the State of Colorado as decreed in Case No. 80CW379, <br /> <br /> <br />Water Division 1. The applicant and the Colorado Water <br /> <br /> <br />Conservation Board agree that in the event the Colorado <br /> <br /> <br />Water Conservation Board calls for administration of water <br /> <br /> <br />rights for the benefit of the water right decreed in Case No. <br /> <br /> <br />80CW379, water rights with the most junior priority dates, or <br /> <br /> <br />changes of water rights with the most junior filing dates, <br /> <br /> <br />should be curtailed first, e.g., a change of water rights or <br /> <br /> <br />water right filed for in 1981 should be curtailed prior to <br /> <br /> <br />the water rights changed by this decree. However, the manner <br /> <br /> <br />of administration or implementation of the subordination <br /> <br /> <br />agreement in the previous sentence is not binding on the <br /> <br /> <br />State Engineer or Division Engineer who, by law, administer the <br /> <br /> <br />streams and rivers of the state. <br /> <br />. <br />
