Walker <br />Deputy Director <br /> <br />TO: <br /> <br />Members, CWCB <br /> <br />FROM: <br /> <br />Bill McDonald, Director <br /> <br />DATE: <br /> <br />January 7, 1985 <br /> <br />SUBJECT: Agenda Item 9b, January 14-15, 1985, Board Meeting <br />Ratify Stipulations <br />Case No. 1-80CW468, City of Lafayette <br /> <br />Background <br /> <br />In 1980, the City of Lafayette filed an application <br />requesting approval to divert its interest in the <br />Leyner-Cottonwood Ditch and the Coal Ridge Ditch Company's <br />South Boulder Creek water rights (Dry Creek Davidson, <br />Enterprise, South, and Central Ditches) at several alternate <br />points of diversion located within the Board's instream flow . <br />reach on S. Boulder Creek. Lafayette's South Boulder Creek <br />rights total 7.035 cfs and bear very senior priority dates. <br /> <br />This change of water rights, if granted, could <br />potentially injure the Board's instream flow right on South <br />Boulder Creek. At the Board's request, an Entry of <br />Appearance was filed in this case. <br /> <br />Staff Action <br /> <br />The City of Lafayette has agreed in principle to <br />subordinate to the Board's instream flow right on South <br />Boulder Creek. A proposed stipulation has been submitted to <br />the applicant's attorney and it is expected that the <br />language will be finalized by the time of the Board <br />meeting. <br /> <br />A copy of the proposed stipulation is attached for your <br />information. <br /> <br />Staff Recommendation <br /> <br />It is recommendeq that the Board ratify the proposed <br />stipulation and authorize the staff to maintain the Entry of <br />Appearance until such time as a stipulated decree is <br />executed. <br /> <br />. <br /> <br />JWM/gI <br />Attachment <br /> <br />217 <br />ai/9b-2 <br />
