<br />-4- <br /> <br />Agenda Item 7c. - Creation of the Chatfield Reallocation Corp's FCSA Study Fund <br /> <br />The Corps advised tile CWCB that additional funds and a schedule extension would be required to complete the <br />performance of tile work tasks under tile FCSA dated September 2, 1999. This agreement is for a contracted <br />dollar amount of$1,984,684. Fortunately, many of tile 72 required tasks have been completed or are well <br />underway. Through tile initial hydrologic and hydraulic determinations or a project feature modification, tile <br />Corps may offer up to 20,600 acre-feet of additional water supply to tile State pending the findings of tile fmal <br />Environmental Impact Statement and Feasibility Study. The Corps estimates tilat $1,330,000 is needed to <br />complete all of tile work tasks and finish the study. <br /> <br />The FCSA is a SO/50 cost share agreement between the Corps and the non-federal study sponsor (CWCB). The <br />non - federal cash cost share for project completion is approximately $665,000. CWCB staffis not requesting <br />$665,000 but requested $150,000 in H.B. 1221 to continue the study into FY 05 and meet commitments in the <br />FCSA witil tile Corps. The remaining $515,000 would come from the water user entities and fulfill the Board's <br />cost sharing requirement as stated in the FCSA. <br /> <br />The Board did receive its $150,000 and contracted these funds to the Corps by a Change Order Letter - No. 04- <br />01 dated December 12, 2004. <br /> <br />The Corps has stated that it does not want to contract with the individual water user entity interested in storage <br />space in Chatfield Reservoir. To accomplish this contract requirement and meet the intent of the "Letter of <br />Commitment" which was considered in CWCB Agenda Item Th. The Board has the authority to create a special <br />fund to accept and expend donations for specific purposes. This authority is cited in Section (3) (a) of the <br />Construction Fund statute which reads "The board may receive and expend contributions of money, property, ( <br />equipment from any source for use in making investigations, contracting projects, or otherwise carrying out the <br />purposes of sections 37- 60 -122 G.R.S. " <br /> <br />In response to the FCSA, the staff proposes the creation of the "Chatfield Reallocation Corps' FCSA Study <br />Fund". Funds in this account will only be available to the Board for the Chatfield Reservoir Feasibility <br />. Reallocation Study. <br /> <br />Staff Recommendation <br /> <br />Staff recommendation is that the Board acknowledge the need and does create a Chatfield Study Fund known as <br />the "Chatfield Reallocation Corps FCSA Study Fund". <br /> <br />Agenda Item 7d. - Presentation by the Corps on the Environmen'tal Impact Investigation Process and the <br />Chatfield Antecedent Flood Study <br /> <br />To bring the additional water supply storage to fruition, two very important study tasks must be satisfactorily <br />completed which are Environmental Impact Investigation and the Chatfield Antecedent Flood Study. During <br />October 2004, the Corps, in cooperation with the CWCB, conducted BIS Scoping Meetings for the EIS <br />investigation process for the enlargement of the Chatfield Conservation Pool from elevation 5432 M.S.L. to <br />5444 M.S.L. We have received 43 meeting comments to date ranging from total support for a pool enlargement <br />to no additional space, which will endanger habitat lands or areas. The recreational impacts to the existing <br />complex are also of great concern to government and the private sectors. The Corps is scheduling additional <br />ErS Scoping Meeting to address more specific federal, state and local agency concerns. These government <br /> <br />Flood Protection.
