4.3.3 Conditions Governinq Grantinq of Variances

Variances affecting Floodway Districts will not be
issued if any increase in base flood levels would
result during the base flood or if the requirements
of Subsection 3.1 of the regulations would be
violated.

Variances will only be issued upon a determination
that the variance is the minimum necessary,
considering the flood hazard, to afford relief.

Any applicant to whom a variance is granted will be
given written notice that the structure(s) will be
permitted to be built with a lowest floor elevation
below the base flood elevation, that premium rates
for flood insurance will increase significantly,
and that such construction below the base flood
elevation increases risk to life and property.

Generally, variances may be issued for new
construction and substantial improvements to be
erected on a lot of one-half acre or less in size
contiguous top and surrounded by lots with existing
structures constructed below the base level,
providing items (i-ii) in Section 4.3.2 have been .
fully considered. As the lot size increases beyond
the one-half acre, the technical justifications
required for issuing the variance increases.

Variances may be issued for the reconstruction,
rehabilitation or restoration of structures listed
on the National Register of Historic Places or the
State Inventory of Historic Places without regard
to the procedures set forth in the remainder of
this section.

A community shall (i) maintain a record of all
variance actions, including justification for their
issuance, and (ii) report such variances issued in
its annual or biennial report submitted to the
Federal Emergency Management Agency.

4.3.4 Conditional Variances

On consideration of the factor' of Subsection 4.3.2
of these regulations, the Board of Adjustment may
attach such conditions to the granting of
variances, including a performance guarantee, as it
deems necessary to further the purposes of the
regulations.
