<br />4.3.3 Conditions Governinq Grantinq of Variances <br /> <br />Variances affecting Floodway Districts will not be <br />issued if any increase in base flood levels would <br />result during the base flood or if the requirements <br />of Subsection 3.1 of the regulations would be <br />violated. <br /> <br />. <br /> <br />Variances will only be issued upon a determination <br />that the variance is the minimum necessary, <br />considering the flood hazard, to afford relief. <br /> <br />Any applicant to whom a variance is granted will be <br />given written notice that the structure(s) will be <br />permitted to be built with a lowest floor elevation <br />below the base flood elevation, that premium rates <br />for flood insurance will increase significantly, <br />and that such construction below the base flood <br />elevation increases risk to life and property. <br /> <br />Generally, variances may be issued for new <br />construction and substantial improvements to be <br />erected on a lot of one-half acre or less in size <br />contiguous top and surrounded by lots with existing <br />structures constructed below the base level, <br />providing items (i-ii) in Section 4.3.2 have been . <br />fully considered. As the lot size increases beyond <br />the one-half acre, the technical justifications <br />required for issuing the variance increases. <br /> <br />Variances may be issued for the reconstruction, <br />rehabilitation or restoration of structures listed <br />on the National Register of Historic Places or the <br />State Inventory of Historic Places without regard <br />to the procedures set forth in the remainder of <br />this section. <br /> <br />A community shall (i) maintain a record of all <br />variance actions, including justification for their <br />issuance, and (ii) report such variances issued in <br />its annual or biennial report submitted to the <br />Federal Emergency Management Agency. <br /> <br />4.3.4 Conditional Variances <br /> <br />On consideration of the factor' of Subsection 4.3.2 <br />of these regulations, the Board of Adjustment may <br />attach such conditions to the granting of <br />variances, including a performance guarantee, as it <br />deems necessary to further the purposes of the <br />regulations. <br /> <br />. <br /> <br />-28- <br />
