(1) A showing of good and sufficient cause;

(2) A determination that failure to grant the
variance would result in exceptional hardship
to the applicant, and the hardship is not of
the applicant's own making;

(3) A determination that the granting ofa
variance will not result in increased flood
heights, additional threats to public safety,
extraordinary public expense, create
nuisances, cause fraud or victimization of the
public, or conflict with existing local laws
or r'egulations.

(4) A determination that the development proposed
would weet the requirements of Section 3 of
these regulations to the fullest extent
possible.

Factors to be Considered

In passing upon requests for variances from the
requirements and standards of this regulation, the
Board of Adjustment will consider all technical
evaluations, all relevant factors, all standards
specified in the regulations, the provisions of
30-28-118, CRS, 1973, as amended, and:

(1) The standards listed in Section 4.2.3 of these
regulation;

(2) The danger of life and property due to
flooding or erosion damage;

(3) The importance of the proposed development
with existing and anticipated development;

(4) The compatibility of the proposed development
with existing and anticipated development;

(5) The relationship of the proposed development
to the comprehensive plan and any applicable
floodplain management program;

(6) The cost of providing essential services such
as maintaining or protecting public utility
systems, roads, and bridges during and after
floods.

(7) Any other relevant evidence submitted by the
Administrator, the Colorado Water Conservation
Boar'd, the applicant, or other party at
interest.
