<br />. <br /> <br />4.3.2 <br /> <br />. <br /> <br />. <br /> <br />(1) A showing of good and sufficient cause; <br /> <br />(2) A determination that failure to grant the <br />variance would result in exceptional hardship <br />to the applicant, and the hardship is not of <br />the applicant's own making; <br /> <br />(3) A determination that the granting ofa <br />variance will not result in increased flood <br />heights, additional threats to public safety, <br />extraordinary public expense, create <br />nuisances, cause fraud or victimization of the <br />public, or conflict with existing local laws <br />or r'egulations. <br /> <br />(4) A determination that the development proposed <br />would weet the requirements of Section 3 of <br />these regulations to the fullest extent <br />possible. <br /> <br />Factors to be Considered <br /> <br />In passing upon requests for variances from the <br />requirements and standards of this regulation, the <br />Board of Adjustment will consider all technical <br />evaluations, all relevant factors, all standards <br />specified in the regulations, the provisions of <br />30-28-118, CRS, 1973, as amended, and: <br /> <br />(1) The standards listed in Section 4.2.3 of these <br />regulation; <br /> <br />(2) The danger of life and property due to <br />flooding or erosion damage; <br /> <br />(3) The importance of the proposed development <br />with existing and anticipated development; <br /> <br />(4) The compatibility of the proposed development <br />with existing and anticipated development; <br /> <br />(5) The relationship of the proposed development <br />to the comprehensive plan and any applicable <br />floodplain management program; <br /> <br />(6) The cost of providing essential services such <br />as maintaining or protecting public utility <br />systems, roads, and bridges during and after <br />floods. <br /> <br />(7) Any other relevant evidence submitted by the <br />Administrator, the Colorado Water Conservation <br />Boar'd, the applicant, or other party at <br />interest. <br /> <br />-27- <br />
