<br />. <br /> <br />. <br /> <br />4.4 <br /> <br />. <br /> <br />4.3.5 Appeals <br /> <br />An applicant for a floodplain development permit or <br />any persons claiming to be affected by the granting <br />or denial of any such a permit may appeal such <br />granting or denial. Anyone weighing to request <br />changes to or rejection of the official maps and <br />base flood elevations, or any part thereof, may <br />appeal the maps. Appeals shall be filed with the <br />Administrator, and engineering and technical data <br />shall be furnished to support the appeal. After <br />the engineering and technical data have been <br />reviewed by the Administrator, the Colorado Water <br />Conservation Board, and the Federal Emergency <br />Management Agency and found to be accurate, the <br />official map and base flood elevations will be <br />amended and redesignated by the Colorado Water <br />Conservation 80ard. Appeals that are denied by the <br />Administrator may be brought to the Board of Board <br />of Adjustment within thirty days of the granting or <br />denial of such permit. <br /> <br />An applicant or any persons claiming to be affecEed <br />by the decision of the Board of Adjustment may <br />appeal such decision for trial de novo to the <br />district court for the county in which the decision <br />was rendered by filing a notice of appeal with said <br />district court within thirty days of the issuance <br />of a final decision by the 80ard of Adjustment. <br /> <br />Enforcement and Penalties <br /> <br />4.4.1 <br /> <br />Inspection and Documentation of Floodplain 8uilding <br />Construction and the Floodplain Development - The <br />Administrator is hereby empowered and directed to <br />inspect and examine the use, occupation, or <br />development of floodplains subject to these <br />regulations for the purpose of determining from <br />time to time whether any use, occupation, <br />development, or activity is in violation or any of <br />the provisions of these regulations or any permit <br />issued or required pursuant to this or other <br />applicable regulations. <br /> <br />Prior to the issuance of a Certificate of Occupancy <br />or a Certificate of Zoning Compliance, the. <br />structure is to be inspected to assure that it was <br />built in full compliance with the applicable <br />floodplain management requirements. In addition, <br />the (local buildinq official) is to require that <br />the Applicant obtain a certificate from a <br />registered professional or licensed land surveyor <br />indicating the as-built elevation of the lowest <br /> <br />-29- <br />
