The study will be finalized in January. <br /> <br />WQCC: The WQCC will soon submit to the EPA the Colorado 303 (d) list (list of impaired water bodies <br />requiring development ofTMDLs) for 2002. The 2004list will follow shortly thereafter. <br /> <br />WQCD: The Final Section 309 Report was delivered to the legislature on time December 1, 2003. The <br />report contained a few recommendations, including a pilot project for refmed use categories and minor <br />changes to the recreational use classifications. The report also recommended for continued studies and <br />meetings on the net environmental benefit issue until November 2004. Pollutant trading policy beyond <br />point source-point source trade (e.g. point source-nonpoint source) may include habitat restoration as a <br />trade. Draft pollutant trading policy will be ready next year. <br /> <br />DOA: The fund for ground water protection has been reduced. A bill may be introduced next year to <br />remove statutory cap in order to raise more money for the Ground Water Protection Fund. Ground water <br />monitoring program along the Arkansas River will continue in cooperation with Dr. Robert Ward at CSU <br />and in coordination with David Robbins at Hill & Robbins. <br /> <br />DOW: The DOW may provide additional comments for the Section 309 Study Report. <br /> <br />SEa: The SEO conducted a hearing on Senate Bill 03-278, Water Administration Fee Program, on <br />December I. The Eagle River Group (Vail, Eagle Water and Sanitation Authority, etc.) represented by <br />Glenn Porzak may file suit against the SEa in the Denver District Court, asserting unconstitutionality of <br />such rules and requirements. SEO has submitted a consultation request to the WQCD concerning <br />potential adverse water quality impact from the City of Aurora's proposed exchange of water from Pueblo <br />Reservoir to Twin Lakes and Turquoise Reservoirs. Such impacts would generally be due to reduction of <br />flow in the Arkansas River. However, the Colorado Supreme Court has previously ruled that reduction of <br />dilution flow is not an injury to other water rights. <br /> <br />Future Meeting <br />The next meeting is scheduled for Tuesday, March 2, 2003 from 2 to 4 in the Room 719 iri the Centennial <br />Building (1313 Shennan St.). <br />
