We
advertised the annually renewable contract position through an RFP process and have received five
applications. A selection panel is actively evaluating the applicants and plans to interview up to four
candidates in late January.

Flood Documentation Update: CWCB staff and Icon Engineering were involved in the documentation
of a devastating flood event in Golden occurred in June 2004. The CWCB recently received notice that up
to three homeowners located in the flood damage area, located along Arapahoe Gulch, have filed suit
against the City of Golden for damages they incurred from the flood event.

A portion of the factual basis for the lawsuits is derived from flood information provided by the CWCB
flood documentation report for that event.

We are not directly named in the lawsuit and the Attorney General's office has determined that the Board
has no liability in the matter; however, it is highly likely that staff will be called to assist in the court case
in order to explain, justifY, and clarify the language contained in the subject report.

Emergency Flood Response Annual Report: The Annual Report for the Flood Response Fund has been
finalized, approved by EDO, and has been posted to our web site. The final report can be reviewed at:
http://cwcb.state.co.us/flood watch/Flood Reports/FRF ArmuaIReport2004.pdf.

A copy has been attached for your information.

Community Assistance Program (CAP) FY 2004 Grant Closed Out: The final closeout for the Fiscal
Year 2004 CAP grant was submitted in December 2004. This was a very successful year for the CAP
program, and FEMA continues to state that Colorado is a recognized leader nationally in the flood
protection arena.

.

.

.

12
