<br />. <br /> <br />. <br /> <br />. <br /> <br />- 3- <br /> <br />Easement and Fee Considerations <br />CWCB Procedures for computing easement fees for the ewCB South Platter River Right of Way <br />Easements use three methods. Method I is the Market Value Method, Method n is the Impact Method, <br />and Method III is the Special Use Consideration. A site survey shows a 20-foot pennanent stormwater <br />pipe easement is needed and will impact 0.049 acres. Therefore, this project utilizes 2134.44 square <br />feet of the CWCB ROW lands. <br /> <br />. Using Method m - the Impact Value Method would include a value of $lO/square foot, at a <br />50% impact fee for drainage pipes, therefore $5/square foot for 2134.44 square feet. The CWCB <br />is eligible to collect $10,672.20 plus the $500 easement application fee for a total of$11,172.20. <br />. The Roxborough lener requests that the CWCB waive the fee as this is a small part of the larger <br />pipeline project previously approved by the CWCB for a $50,000. <br />. This relocation is anticipated to improved drainage at the current site and address a longstanding <br />ponding issue. <br /> <br />RECOMMENDA nON <br />Following a review by the AG's Office and CWCB staff for Agenda Item 13, stafTrecommends that the <br />Board: <br />Approve the construction easement and non-exclusive easement request for the Roxborough <br />Park Metropolitan District - Stormwater pipeline relocation in Englewood, Colorado located on <br />CWCB right-of-way. The easement fee is considered W1der Method III (Special Use <br />Considemtion), which shall include a total of $500 and other considerations for the easement <br />and application fee. The Board authorizes staff to prepare the necessary easement documents <br />and authorizes the Director to execute said docwnents. It is further recommended that the <br />grantee shall be subject to a non-exclusive clause, shall implement a construction safety <br />program, and shall coordinate activities with all other easements within the subject area. <br /> <br />flood Protection.
