. . . - 3- Easement and Fee Considerations CWCB Procedures for computing easement fees for the ewCB South Platter River Right of Way Easements use three methods. Method I is the Market Value Method, Method n is the Impact Method, and Method III is the Special Use Consideration. A site survey shows a 20-foot pennanent stormwater pipe easement is needed and will impact 0.049 acres. Therefore, this project utilizes 2134.44 square feet of the CWCB ROW lands. . Using Method m - the Impact Value Method would include a value of $lO/square foot, at a 50% impact fee for drainage pipes, therefore $5/square foot for 2134.44 square feet. The CWCB is eligible to collect $10,672.20 plus the $500 easement application fee for a total of$11,172.20. . The Roxborough lener requests that the CWCB waive the fee as this is a small part of the larger pipeline project previously approved by the CWCB for a $50,000. . This relocation is anticipated to improved drainage at the current site and address a longstanding ponding issue. RECOMMENDA nON Following a review by the AG's Office and CWCB staff for Agenda Item 13, stafTrecommends that the Board: Approve the construction easement and non-exclusive easement request for the Roxborough Park Metropolitan District - Stormwater pipeline relocation in Englewood, Colorado located on CWCB right-of-way. The easement fee is considered W1der Method III (Special Use Considemtion), which shall include a total of $500 and other considerations for the easement and application fee. The Board authorizes staff to prepare the necessary easement documents and authorizes the Director to execute said docwnents. It is further recommended that the grantee shall be subject to a non-exclusive clause, shall implement a construction safety program, and shall coordinate activities with all other easements within the subject area. flood Protection.
