<br />186 <br /> <br />Mr. Hinderlider said he is in favor of the investigation - <br />worthwhile. Inform our ovm water users and see if they can adjust <br />their diversions as they see fit. Regulate diversions this year in <br />San Luis Valley. .By a cOlrrt of competent jurisdiction this danger <br />might be mitigated. Texas would say Colorado has done all it can do <br />in this matter of shortage. Should take cognizance of it and find out <br />.facts. <br /> <br />~mr. Moses: Wagon ~~eel Gap, Our situation is this in ~an Luis <br />Valley: Conservation District organized for some three years. <br />Bureau of Reclamation has completed its report - been approved by <br />Office of County Commissioners and referred to the Secretary of In- <br />terior. Question now arises reearding the Secreta~J's choice of <br />following three procedures: <br /> <br />I <br /> <br />1. Authorize us or to pass on to Congress for authorization. <br />2. Possibility of reauthorizing himself. ' <br />3. The one we want, and the only one we want, is to say this <br />was authorized by the Secretary of the Interior in 1940 <br />and we are going to send it out to several states for com- <br />ment; going to refer to Bureau of Budget in its appropria- <br />tions act. . <br /> <br />Two or three straws in the wind in Congress indicate Secretary's <br />office is rieht on the fence in the matter. Hope We can hang on to the <br />1940 authorization. Nevr Mexico engaged in building two dams under <br />later authorizations. If they get those completed and in operation <br />and we are obliged to use 1953, we are in a bad way. If we can get a <br />resolution ~rom this Board requestine support to use 1940 authorization <br />vnthout any slwmission to'the states or any reauthorization we want to <br />go about it this way. Mr. Breitenstein tells me that was done on <br />Conejos in 1940 - eot their appropriation and constructed the dam. We <br />need the help of this Board and their approval. I discussed it vnth <br />Judge Stone. - He said to use the original appropriation and battle for <br />40% benefits. -Never presented before the Board before. Didn't think <br />we were ready until now. We are seekine for your help. <br /> <br />Mr. Breitenstein: I agree with what Mr. Moses has said - no <br />reauthorization on the Conejos; without any action by Congress or re- <br />submission of the project to the affected states. Seems to me that it <br />is desirable to take the action requested by Mr. Moses. Should go <br />forward on the basis of 1940 authorization without resubmission to <br />Congress or resubmission to the affected states. <br /> <br />Mr. Dutcher said Mr. Moses should be permitted to submit his <br />resolution. <br /> <br />I <br />
