CWCB staff has conducted a water availability analysis including a review of the historic gage <br />records from the USGS gage located on Fourmile Creek below Cripple Creek, Fourmile <br />Creek diversion records, precipitation records from four local precipitation stations near <br />Canon City, Guffy, Elevenmile Reservoir and Ruxton Park. In addition to the above staff also <br />met with the Steve Witte, the Division 2 Engineer, and his Division 2 water commissioners to <br />discuss any potential water availability issues. <br />. CWCB staff has determined that adequate water supplies exist such that the natural <br />environment may be preserved without limiting or foreclosing the exercise of valid existing <br />water rights. <br /> <br />. Cripple Creek and Victor Gold Mine (CCVGM) - CCVGM has provided the staff with <br />information regarding their application for a surface water right and appropriative rights of <br />exchange. CCVGM filed their application on September 18, 1998. Staffmet with representatives <br />from the CCVGM to try and resolve any issues both parties may have. On November 2, 1998, <br />staff received a settlement proposal from the CCVGM. The CCVGM is claiming a junior <br />conditional appropriation date (September 18, 1998) for 3 points of diversion for mining and <br />milling uses, domestic, irrigation, commercial, industrial, recreational, augmentation, exchange, <br />and all other beneficial purposes. CCVGM is also requesting a three cfs direct flow exchange up <br /> <br />. Page 3 00 <br />
