<br />November 9, 1998 - Field Trip and Neighborhood Meeting at the Canterbury Ranch - CWCB <br />answered questions and took Public Comment. <br /> <br />- <br />. <br /> <br />In addition to the above notices and CWCB meetings, information regarding instream flow <br />recommendations were also available on CWCB's Internet Web Pages located on the world wide <br />web. The public has had over 270 days or nine months, to provide written and/or verbal comments <br />to the Board and staff regarding these recommendations, although only 120 days are required by the <br />Board's instream flow procedures, Instream flow recommendation case files and investigation files <br />have been available for public review at the Colorado Water Conservation Board office and at each <br />Board meeting since the Board formed its intent to appropriate. In addition to the above files, <br />Instream Flow Recommendation Summary Reports have been available for public review at the <br />Division Engineer's Office in Pueblo. The above files are also submitted as part of the administrative <br />record, <br /> <br />Issues Re~arding Specific Streams <br /> <br />Fourmile Creek Segments <br /> <br />Prior to the Board taking final action on this recommendation, pursuant to Rule 12, the staff sought <br />and received comments and concerns from The Cripple Creek and Victor Gold Mining Company <br />(CCVGMC), City of Cripple Creek (CCC), The Pisgah Reservoir and Ditch Company (pRDC), <br />Catlin Canal Company (Catlin) and several local water rights owners. The staff has completed <br />additional water availability analysis as requested by the above parties and has made some flow <br />adjustments to the Board's proposed ISF recommendations. . <br /> <br />The four reaches are presented in an upstream to downstream order. Staff feels the following facts <br />are based on the best available data to date: <br /> <br />F ourrnile Creek #3 <br /> <br />. The BLM documented that a natural environment is present in the form of a brook and <br />brown trout fishery. <br /> <br />. Based on the BLM's biological recommendation, flows of6 cfs, summer, and 2.5 cfs, <br />winter, are necessary to preserve the natural environment to a reasonable degree. <br />However, the summer instream flow recommendation was reduced to 3.0 cfs (8/1-10/31) <br />based on the water availability analysis. The BLM believes the lower flow ' <br />recommendation will still preserve the natural environment. <br /> <br />Fourmile Creek #2 <br /> <br />.
